EXPLANATORY NOTE NOTE EXPLICATIVE The Highway Traffic Act is amended to impose additional consequences when an impaired driving offence involves bodily injury or death. A lifetime licence suspension is imposed on a person who is convicted of two such offences committed within a 10-year period. Additionally, a person who is convicted of such an offence is prohibited from driving with any alcohol in their blood for a 7-year period. A second conviction for such an offence results in a lifetime prohibition if the second offence is committed within 10 years after the first one.

Unlike the licence suspension period, the alcohol prohibition period cannot be varied by the Licence Suspension Appeal Board. A person who drives with alcohol in their blood while prohibited from doing so is subject to having their licence suspended and their vehicle impounded. The person might also be required to pay an administrative penalty or to participate in an impaired driving assessment or the ignition-interlock program. An amendment is also made to The Drivers and Vehicles Act.

Le Code de la route est modifié afin d'imposer des sanctions supplémentaires lorsque des blessures corporelles ou un décès surviennent à la suite d'une infraction de conduite avec facultés affaiblies. Les personnes qui ont été déclarées coupables de deux infractions de ce type commises au cours d'une période de 10 ans se voient imposer la suspension de leur permis de conduire à vie. De plus, il est interdit aux personnes déclarées coupables d'une telle infraction de conduire alors qu'elles ont de l'alcool dans le sang, et ce, pendant sept ans.

Une deuxième déclaration de culpabilité pour une telle infraction entraîne une interdiction à vie de conduire avec de l'alcool dans le sang si la deuxième infraction a été commise dans les 10 ans après la première. Contrairement à la période de suspension de permis, la période d'interdiction de conduire avec de l'alcool dans le sang ne peut être modifiée par la Commission d'appel des suspensions de permis. Les personnes qui conduisent avec de l'alcool dans le sang alors qu'il leur est interdit de le faire se voient imposer la suspension de leur permis et la mise en fourrière de leur véhicule.

Elles pourraient également être tenues de payer une sanction administrative ou de participer à une évaluation relative aux conducteurs ayant conduit avec facultés affaiblies ou au programme de verrouillage du système de démarrage. Une modification est également apportée à la

Loi sur les conducteurs et les véhicules.

k) whether the suspension and disqualification order served on the person was the first, second, third, fourth or more served on the person during the relevant 10-year period. 6

7(1) Subsection 264(1) is amended (

a) in the part before the first definition, by adding "and in

section 264.1" after "this section"; and (

b) by adding the following definition: "designated impaired offence" means an offence (

a) referred to in clause (

a) or subclause (a.2)(

i) of the definition "Category B offence", or (

b) committed before December 18, 2018, under the following provisions of the Criminal Code as they read at the time the offence was committed: (i) subsection 255(2) (impaired driving causing bodily harm), (ii) subsection 255(2.1) (blood concentration equal to or over legal limit — bodily harm), (iii) subsection 255(2.2) (failure or refusal to provide sample — bodily harm), (iv) subsection 255(3) (impaired driving causing death), (v) subsection 255(3.1) (blood concentration equal to or over legal limit — death), (vi) subsection 255(3.2) (failure or refusal to provide sample — death); (« infraction désignée pour conduite avec facultés affaiblies ») 7(1) Le paragraphe 264(1) est modifié par adjonction :

Where appeal not allowed 264.1(8) Upon the disposition of the appeal, if the judgment of the court is that the appeal be not allowed, the judge or judges of the court shall, when delivering judgment, send, or cause to be sent, to the registrar formal notification of the disposition of the appeal; and the alcohol prohibition stayed by the direction under subsection (6) shall become operative upon the receipt by the registrar of the formal notification of the disposition of the appeal.
