Alberta Regulation 230/2002
Marketing of Agricultural Products Act
ALBERTA MILK REMUNERATION AND EXPENSE REGULATION

Made by the Alberta Agricultural Products Marketing Council on September
17, 2002 pursuant to
section 20 of the Marketing of Agricultural Products
Act.
1 Words used in this Regulation that are defined in the Alberta Milk Plan
Regulation (AR 150/2002) have the same meaning as defined in that
regulation.
2(1) Subject to subsection (2), the Council authorizes Alberta Milk to pay
remuneration and expenses to Alberta Milk members as set out in the
Schedule.
(2) If remuneration is fixed pursuant to a vote under
section 11 of the
Alberta Milk Plan Regulation (AR 150/2002), payment must be made in
accordance with that vote and not in accordance with subsection (1).
3 The Council authorizes Alberta Milk to establish policies regarding the
processing and payment of remuneration and expenses to its directors,
delegates and members, including the requirement that remuneration and
expense claims be submitted in a form acceptable to Alberta Milk.
4 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be repassed in
its present or an amended form following a review, this Regulation expires
on August 31, 2007.

PERSONAL PROPERTY SECURITY FORMS REGULATION

section 3 of the Personal Property Security Act.
Forms prescribed
1 The forms in the
Schedule are prescribed for the purposes of the
Personal Property Security Act and the Personal Property Security
Regulation (AR 95/2001).
Repeal
2 The Personal Property Security Forms Regulation (AR 295/90) is
repealed.
Expiry
3 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be repassed in
its present or an amended form following a review, this Regulation expires
on June 30, 2012.

Municipal Government Act
ELECTRIC ENERGY GENERATION EXEMPTION REGULATION

1 Notwithstanding sections 358, 359.1(4) and 359.2(4) of the Act, the
Minister may in respect of a taxation year, to any extent the Minister
considers appropriate, exempt electric power systems intended for or used
in the generation of electricity from taxation for the purpose of raising
revenue needed to pay the requisitions referred to in
section 326(a)(ii)
and (iii) of the Act.
2 The Electric Energy Generation Exemption Regulation (AR 318/2000) is
repealed.
3 This Regulation is repealed in accordance with
section 603(2) of the
Act.
4 This Regulation comes into force on January 1, 2003.

Municipal Government Act
EXTENSION OF LINEAR PROPERTY REGULATION

i) of the Act, linear property is to
be construed as including an electric power system intended for or used in
the generation of electricity owned or operated by a person whose rates are
not controlled or set by the Public Utilities Board or by a municipality or
under the Small Power Research and Development Act but not including,
unless the Minister otherwise directs, an electric power system that is
owned or operated by a person generating or proposing to generate
electricity solely for the person's own use.
2 The Extension of Linear Property Regulation (AR 319/2000) is repealed.
3 This Regulation is repealed in accordance with
section 603(2) of the
Act.
4 This Regulation comes into force on January 1, 2003.

Podiatry Act
REGULATION TO AMEND THE BY-LAWS OF THE
ALBERTA PODIATRY ASSOCIATION

1 The By-laws of the Alberta Podiatry Association (AR 195/65) are amended
by this Regulation.
Section 2 is amended by repealing by-law III and substituting the
following:
III Fees, Dues and Fiscal Year:
(
a) In accordance with
section 4(1)(
e) of the Podiatry
Act, the Association fixes the following fees:
(
i) the membership fee for the year ending
December 31, 2002 is $2000;
(ii) the membership fee for the year ending
December 31, 2003 is $2400;
(iii) the membership fee for the year ending
December 31, 2004 is $2800;
(iv) the fee for an interim licence or
temporary membership is, for each quarter of the fiscal year, 35% of the
annual fee set out in subclause (i), (ii) or (iii);
(
v) the fee for the issuance of a
certificate of registration is $500.
(
b) Fees are payable to the secretary-treasurer of the
Association.
(
c) The fiscal year of the Association is January 1 to
December 31.

AMENDMENT REGULATION

1 In this Regulation,
(a) "Board" means the Alberta Energy and Utilities Board;
(b) "complaint" means a complaint under
section 4 that the Board
decides warrants a review;
(c) "disputed account" means an account that is the subject of a
complaint;
(d) "eligible customer" has the meaning given to it in the
Regulated Rate Option Regulation (AR 132/2001);
(e) "regulated rate tariff provider" means a person designated by
the Minister under
section 2(a).
Ministerial designation
2 For the purposes of this Regulation, the Minister may
(
a) designate regulated rate tariff providers to whom this
Regulation applies, and
(
b) specify the service area in respect of which this Regulation
applies.
Right to receive account
3(1) Each eligible customer who purchases electricity services from a
regulated rate tariff provider has the right to receive an account from the
provider that accurately sets out the charges that the eligible customer is
to pay.
(2) If the charges are based on estimates of electric energy consumption
made by the regulated rate tariff provider, the estimates must be fair and
reasonable.
Customer complaints
4(1) An eligible customer of a regulated rate tariff provider may make a
complaint to the Board about an account from the regulated rate tariff
provider if the eligible customer reasonably and in good faith believes
(
a) that the account does not accurately set out the charges that
the eligible customer should pay, or
(
b) that, if the account is based on estimated electric energy
consumption, that the estimates are not fair and reasonable.
(2) An eligible customer is not entitled to make a complaint about whether
the regulated rate tariff provider is authorized to charge the eligible
customer for services and other matters pursuant to the Regulated Rate
Option Regulation (AR 132/2001) or the Electric Utilities Act.
(3) When making a complaint, the eligible customer must provide the Board
with any information the Board requires.
Responding to complaints
5(1) If the Board decides that a complaint warrants a review, the Board
must send information about the complaint to the eligible customer's
regulated rate tariff provider.
(2) On receipt of the information sent by the Board, the regulated rate
tariff provider must, within 60 days of receiving the information, satisfy
the Board that
(
a) it accepts as accurate the eligible customer's estimate of
consumption of electric energy and has issued a replacement account based
on that estimate,
(
b) it has issued a replacement account to the eligible customer
showing actual electric energy consumption, as evidenced by an actual meter
reading,
(
c) the account is within a tolerance of 20% above or below the
average daily consumption of electric energy as set out in the disputed
account, as evidenced by an actual meter reading, or
(
d) extenuating circumstances exist that justify the charges.
When disputed account settled in customer's favour
6 If the regulated rate tariff provider does not satisfy the Board within
60 days in accordance with
section 5(2), the complaint is conclusively
settled in the eligible customer's favour and the regulated rate tariff
provider
(
a) must issue a replacement account based on a customer supplied
meter reading,
(
b) must provide the eligible customer with a credit of $75 on the
disputed account, or if that account is less than $75, the balance of that
credit must be applied to future accounts of the eligible customer, and
(
c) must not require the eligible customer to pay or charge the
eligible customer any interest, penalty or other amount as a result of the
eligible customer not paying the disputed account.
Effect of large variations
7 If the average daily consumption of electric energy set out in a
replacement account issued under
section 6 varies more than 20% above or
below the average daily consumption of electric energy set out in the
disputed account, the regulated rate tariff provider
(
a) must provide the eligible customer with a credit of $75 on the
replacement account, or if the replacement account is less than $75, the
balance of that credit must be applied to future accounts of the eligible
customer, and
(
b) must not require the eligible customer to pay or charge the
eligible customer any interest, penalty or other amount as a result of the
eligible customer not paying the amount of the disputed account.
Burden of proof
8 In proceedings before the Board, the regulated rate tariff provider has
the burden of proving that it has complied with this Regulation.
Duties and powers of the Board
9(1) The Board must
(
a) make or approve any tariffs, rules, procedures or practices it
considers necessary or appropriate to give effect to this Regulation, and
(
b) resolve any issue arising from the
interpretation or
application of this Regulation.
(2) The Board may do any or all of the following:
(
a) order that while a complaint remains unresolved, an eligible
customer is obligated to pay only the amount that the Board determines to
be fair and reasonable;
(
b) make any order that it considers appropriate or necessary to
ensure that a regulated rate tariff provider complies with this Regulation;
(
c) impose a fine on a regulated rate tariff provider of not more
than $100 000 a day for each day during which the regulated rate tariff
provider fails to comply with this Regulation or with an order of the
Board;
(
d) order a regulated rate tariff provider to include a notice, in
the form and using the words specified by the Board, on all accounts sent
to eligible customers, about the rights and duties in this Regulation;
(
e) dismiss a complaint and order that the existing terms and
conditions of a regulated rate tariff apply to the eligible customer;
(
f) if a meter reading shows that a disputed account is reasonable,
and the Board considers the complaint to have been frivolous or vexatious,
order the eligible customer to pay an off-cycle meter reading charge of not
more than $75;
(
g) from time to time assess its training, staff, administrative
and operational costs under this Regulation and direct a regulated rate
tariff provider, or if there is more than one, 2 or more providers, to pay
those costs in the amount and proportion specified in its order, giving
reasons for the apportionment.
Protection for customer
10(1) While a disputed account remains unresolved, the regulated rate
tariff provider
(
a) has no recourse against the eligible customer who made the
complaint by way of penalty, interest, service reduction, interruption or
stoppage or by other action, and
(
b) may not take any action or provide any information that would
affect the eligible customer's historical credit rating.
(2) No person may take or attempt to take any recourse described in
subsection (1) while a disputed account remains unresolved.
Costs
11(1) A regulated rate tariff provider is not entitled to recover and the
Board may not permit the recovery of any costs referred to in
section
9(2)(
g) or under subsection (2) by or through a regulated rate tariff or
any other tariff or by any other means, directly or indirectly.
(2) All costs payable or incurred by a regulated rate tariff provider as a
result of the administration, operation, implementation and compliance with
this Regulation are to be paid by the regulated rate tariff provider who
incurs them.
Resolving conflict
12 In the event of a conflict or inconsistency between this Regulation
and any other regulation, tariff or agreement, this Regulation prevails.
Expiry
13 This Regulation is made under
section 72(1) of the Electric Utilities
Act and is repealed in accordance with
section 72(2) of that Act.
Coming into force
14 This Regulation comes into force on December 2, 2002 and applies only
to accounts issued by a regulated rate tariff provider on or after that
date.

Electric Utilities Act
TRANSMISSION ADMINISTRATOR TARIFF DEFICIENCY
CORRECTION REGULATION

section 72 of the Electric Utilities Act.
1 When considering whether to approve the tariff of the Transmission
Administrator that is to have effect for the year 2003, the Alberta Energy
and Utilities Board must include in that tariff the ability of the
Transmission Administrator to recover an amount equal to
(
a) the aggregate of
(
i) the price paid by the Power Pool Council or its
subsidiary to acquire the shares of ESBI Alberta Ltd.,
(ii) all reasonable transition costs incurred by the
Power Pool Council or its subsidiary related to acquisition of the shares
of ESBI Alberta Ltd., and
(iii) any additional income or corporate taxes payable by
the Transmission Administrator as a result of including the price referred
to in subclause (
i) and the costs referred to in subclause (ii) in the
Transmission Administrator's tariff,
less
(
b) any management fees collected by the Transmission Administrator
after the date on which the Power Pool Council or its subsidiary acquires
the shares of ESBI Alberta Ltd.
2 The Transmission Administrator must recover the price referred to in
section 1(a)(
i) and the costs referred to in
section 1(a)(ii) after the
payment of the additional income or corporate taxes referred to in
section
1(a)(iii).
3 The Transmission Administrator's tariff is not unjust or unreasonable
simply because it includes the amount referred to in
section 1.
4 This Regulation is made under
section 72(1) of the Electric Utilities
Act and is repealed in accordance with
section 72(2) of that Act.

Mines and Minerals Act
PETROLEUM ROYALTY AMENDMENT REGULATION

2002 pursuant to sections 5 and 36 of the Mines and Minerals Act.
1 The Petroleum Royalty Regulation (AR 248/90) is amended by this
Regulation.
Section 1 is amended
(
a) in subsection (1)(
d) by repealing subclause (iv) and
substituting the following:
(iv) the unit area under a unit agreement or unit
operation order,
(
b) by adding the following after clause (j):
(j.1) "solution gas" means the gaseous component of
petroleum;
(
c) by adding the following after subsection (1):
(1.1) A reference in this Regulation to a month, whether by its name
or not, shall be construed as the period commencing at 7:00 a.m. Mountain
Standard Time on the first day of the month and ending immediately before
7:00 a.m. Mountain Standard Time on the first day of the next month.
Section 2 is repealed and the following is substituted:
Royalty
2(1) The royalty reserved to the Crown on petroleum recovered from a
well event pursuant to an agreement granting petroleum and natural gas
rights, petroleum rights or natural gas rights shall be
(
a) that part of the crude oil obtained from the
petroleum in each month calculated
(
i) where sections 4, 5 and 5.2 do not
apply, in accordance with
Schedule 1,
(ii) where
section 4 applies, in accordance
with
section 4,
(iii) where
section 5 applies, in accordance
with
section 5, or
(iv) where
section 5.2 applies, in
accordance with
section 5.2,
and
(
b) that part of the solution gas obtained from the
petroleum in each month, calculated in accordance with the Natural Gas
Royalty Regulation, 2002
(2) The royalty on crude oil and solution gas shall be free and
clear of all deductions.
Section 5 is amended
(
a) in subsection (2)(c)(
i) by striking out "an oil well" and
substituting "a well";
(
b) in subsection (2)(
c) by repealing subclause (iii.1) and
substituting the following:
(iii.1) a well in respect of which royalty has been

the lessee of the agreement for the delivery of the Crown's royalty share
of crude oil payable under the agreement in respect of that month.

Definitions
1 In this Regulation,
(a) "ballot" means a ballot referred to in Form 3 of the Schedule;
(b) "Board" means the Potato Growers of Alberta as defined in the
Potato Growers of Alberta Plan Regulation;
(c) "Council" means the Alberta Agricultural Products Marketing
Council;
(d) "eligible producer" means a person described in
section 3(
a) who is eligible to vote in the plebiscite;
(e) "licensed producer" means a producer who holds a producer
license issued by the Board;
(f) "Plan" means the revised Potato Growers of Alberta Plan
referred to in
section 3 of the revised Potato Growers of Alberta Plan
Regulation;
(g) "plebiscite" means a plebiscite referred to in
section 3;
(h) "producer" means a producer as defined in the Plan;
(i) "regulated product" means potatoes;
(j) "relevant period" means anytime between January 1, 2002 and
October 31, 2002;
(k) "revised Potato Growers of Alberta Plan Regulation" means the
proposed replacement for the Potato Growers of Alberta Plan Regulation (AR
274/97).
Council to conduct plebiscite
2 The Council must, subject to this Regulation, conduct a plebiscite of
the licensed producers and laboratory and greenhouse potato growers to
determine whether they are in favour of the revised Potato Growers of
Alberta Plan Regulation.
Basic criteria for a plebiscite
3 For the purposes of conducting a plebiscite,
(
a) subject to
section 6, a person must be a licensed producer
during the relevant period or establish that the person grew the regulated
product in a greenhouse or laboratory during the relevant period,
(
b) a sufficient number of eligible producers is not less than 35%
of the eligible licensed producers during the relevant period, and
(
c) a sufficient portion of the regulated product on the relevant
period is not less than 50% of the total amount of the regulated product
that was capable of being produced on field acres during the relevant
period.
Registration with the Council
4(1) For the purposes of the plebiscite, an eligible producer has
voluntarily registered with the Council if the eligible producer has signed
for and received a ballot from the returning officer not later than 11:00
a.m. on November 15, 2002.
(2) Notwithstanding subsection (1), an eligible producer is not registered
pursuant to subsection (1) if that eligible producer is not on the list of
licensed producers and cannot adequately verify to the satisfaction of the
returning officer that that producer is eligible to vote under this
Regulation.
Holding of plebiscite
5(1) If
(
a) a sufficient number of eligible producers as prescribed under
section 3(
b) have registered with the Council under
section 4, and
(
b) those eligible producers who have registered with the Council
under
section 4 were collectively capable of producing a sufficient portion
of the regulated product as prescribed under
section 3(c),
the Council shall be considered to have caused a plebiscite to have been
held and the returning officer must, subject to this Regulation, count the
ballots cast in the plebiscite.
(2) A ballot is cast in the plebiscite by an eligible producer if the
returning officer has, not later than 11:00 a.m. on November 15, 2002,
received from the eligible producer a ballot.
(3) For the purpose of this plebiscite a polling station where eligible
producers may contact the returning officer to register, receive ballots
and cast ballots will be open between 10:00 a.m and 5:00 p.m on November
14, 2002 and between 8:00 a.m. and 11:00 a.m. on November 15, 2002 at the
Board's annual general meeting in Red Deer, Alberta.
(4) If
(
a) a sufficient number of eligible licensed producers as
prescribed under
section 3(
b) have not registered with the Council under
section 4, or
(
b) a sufficient number of eligible producers as prescribed under
section 3(
b) have registered with the Council under
section 4 but those
eligible producers are collectively not capable of producing a sufficient
portion of the regulated product as prescribed under
section 3(c),
the plebiscite shall be considered not to have been held and the returning
officer shall not count the ballots.
Eligible voters
6(1) Subject to subsection (7), a licensed producer who is an eligible
producer may vote in the plebiscite.
(2) Subject to subsection (7), a non-licensed producer who produced the
regulated product in a greenhouse or laboratory during the relevant period
is an eligible producer and may vote in the plebiscite.
(3) An eligible producer may vote only once in the plebiscite.
(4) Subject to subsection (5), only an individual may vote in the
plebiscite.
(5) For the purposes of the plebiscite, only one individual may vote as
the representative of a partnership, corporation or other recognized
business unit by the returning officer.
(6) For the purposes of the plebiscite, a person may vote only once even
though that person may hold more than one license issued by the Board or
may produce any combination of field crops, laboratory crops or greenhouse
crops.
(7) Notwithstanding that Alberta Agriculture, Food and Rural Development
and Agriculture and Agri-Food Canada may hold a producer license or may
grow the regulated product in a greenhouse or laboratory, representatives
of those government research facilities are not eligible to vote in this
plebiscite.
Returning officer
7 The returning officer is a person so designated by the Council.
Duties of returning officer
8 The duties of the returning officer are
(
a) to arrange for the printing of ballots;
(
b) to obtain from the Board a complete list of names, addresses,
and license numbers, and potato field acres during the relevant period;
(
c) to obtain from the Board a complete list of names and
addresses, of non-licensed producers who produced the regulated product in
greenhouses or laboratories during the relevant period;
(
d) when satisfied as to the accuracy and completeness of the list
obtained under clauses (
b) and (c), to adopt the list, subject to
section
6, as the voters list of eligible producers;
(
e) to cause to be available during the plebiscite to every person
on the voters list the following:
(
i) the revised Potato Growers of Alberta Plan
Regulation;
(ii) the letter of explanation as set out in Form 1 of
the Schedule;
(iii) the voting procedure as set out in Form 2 of the
Schedule;
(iv) the ballot as set out in Form 3 of the Schedule;
(
f) to establish a plebiscite polling station at the Board's annual
general meeting held on November 14 and 15, 2002 in Red Deer, Alberta so
that eligible producer may register, receive ballots and cast ballots;
(
g) to investigate the name of any person on the voters list in the
event of any objection as to the eligibility of any voter, if the objection
is made in writing and received by the returning officer not later than
9:00 a.m. on November 15, 2002;
(
h) to strike off from the voters list the name of any person who
the returning officer considers, after reasonable investigation, is not
eligible to vote and to so notify that person.
Non-receipt of ballot, etc.
9(1) If a person
(
a) is on the voters list but has not received a ballot from the
returning officer or has lost the ballot, and
(
b) desires to exercise the right to vote,
that person may apply to the returning officer not later than 9:00 a.m. on
November 15, 2002 for a ballot.
(2) If a person makes an application under subsection (1), the returning
officer may supply a ballot to that person if the returning officer is
satisfied that the person
(
a) does not have a ballot but is entitled to vote in the
plebiscite, and
(
b) has not previously voted in the plebiscite.
Requirement to observe the rules
10 A person shall not vote unless that person complies with the
requirements of this Regulation and observes the voting procedures set out
in the Schedule.
Receipt of ballots by returning officer
11(1) On receiving a ballot, the returning officer must place the ballot
in the voting box.
(2) The returning officer may reject any ballot that, in the opinion of
the returning officer, appears to have been tampered with.
Ballot count
12(1) After the ballots have been placed in the voting box under
section
11, the returning officer must, after 11:00 a.m. on November 15, 2002, open
the voting box and count the ballots contained in the box in the presence
of at least 2 other persons.
(2) The returning officer must reject any ballot
(
a) that is received after 11:00 a.m. on November 15, 2002,
(
b) that has not been supplied by the returning officer, or
(
c) that, in the opinion of the returning officer, does not clearly
indicate the voter's choice.
Report of results
13(1) The returning officer must report the results of the vote to the
Minister of Agriculture, Food and Rural Development, the Council and the
Board.
(2) The returning officer must announce the results of the vote prior to
the close of the Board's annual general meeting on November 15, 2002 and
publish a report of the results of the vote as soon as practical after the
counting of the ballots and post it on the Internet at
www.agric.gov.ab.ca/potato.html.
Recount
14(1) Any eligible producer who is on the voters list may apply in writing
to the returning officer for a recount.
(2) An application for a recount must be made to the returning officer by
November 22, 2002.
(3) If a recount is to be conducted
(
a) the recount must be conducted by the returning officer on or
before November 25, 2002, and
(
b) the producer who requested the recount may be present at the
recount.
Destruction of ballots
15 The returning officer must destroy all ballots on or after 30th day
from the day that the returning officer posts the results of the
plebiscite, unless otherwise directed by a court or the Council.
Direction of returning officer
16 The returning officer may issue any further directions and take any
other actions as may, in the opinion of the returning officer, be necessary
for the proper conduct of the plebiscite.
Substantial compliance
17 A proceeding that is in substantial compliance with this Regulation is
not open to objection on the ground that it is not in strict compliance
with this Regulation.
Expiry
18 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be repassed in
its present or an amended form following a review, this Regulation expires
on January 31, 2003.

To: Alberta Potato Producers
Subject: Plebiscite on the revised Potato Growers of Alberta Plan
Regulation.
In accordance with the provisions of the Marketing of Agricultural Products
Act, the Alberta Agricultural Marketing Council is conducting a vote of
potato producers to determine if producers are in favour of the revised
Potato Growers of Alberta Plan Regulation.
In order to be entitled to vote in this plebiscite, you must be an
"eligible producer". An "eligible producer" is a producer who holds a
Potato Growers of Alberta producer license or produces potatoes in a
laboratory or a greenhouse anytime between January 1, 2002 and October 31,
The returning officer is not authorized to count the ballots unless the 2
following criteria have been met:
(
a) at least 35% of all eligible licensed producer have registered
with the Alberta Agricultural Products Marketing Council (the Marketing
Council) for the purpose of voting in the plebiscite;
(
b) those eligible producers who have registered with the Marketing
Council for the purposes of voting in the plebiscite are capable of
marketing at least 50% of the field acres during the 2002 growing season.
An eligible producer is considered to have registered with the Marketing
Council for the purpose of voting in the plebiscite if the eligible
producer has registered for and received a ballot from the returning
officer not later than 11:00 a.m. on November 15, 2002.
Please read the outline for voting procedure carefully. If you have any
questions regarding the procedure to be followed, contact the returning
officer at the polling station.
Please note that ballots must be received by the returning officer not
later than 11:00 a.m. on November 15, 2002. To ensure that your ballot is
received prior to the deadline, please cast it as soon as possible.
The results of the vote will be announced prior to the close of the Potato
Growers of Alberta annual general meeting held November 15, 2002 and will

Interpretation
1(1) In this Regulation,
(a) "condition defect" means any defect that may develop in
vegetables during storage or transit;
(b) "diameter" means the greatest width at right angles to the
longitudinal axis;
(c) "field cucumbers" means cucumbers that are not greenhouse
cucumbers;
(d) "field tomatoes" means tomatoes that are not greenhouse
tomatoes;
(e) "greenhouse cucumbers" means cucumbers that have been grown in
artificial conditions under glass or other protective covering;
(f) "greenhouse tomatoes" means tomatoes that have been grown in
artificial conditions under glass or other protective covering;
(g) "properly packed" with respect to vegetables means vegetables
that are packed in a package so that they are not slack, overpressed or in
a condition likely to result in damage during handling or in transit.
(2) Definitions in
section 1 of the Vegetable Sales Regulation (AR 105/97)
apply to this Regulation.
Application
2(1) This Regulation applies to fresh vegetables grown in Alberta that are
to be sold in Alberta.
(2) This Regulation does not apply to the following:
(
a) seed potatoes in respect of which a certificate has been issued
pursuant to
section 52(1) of the Seeds Regulations, C.R.C. 1978, c.1400
under the Seeds Act (Canada);
(
b) banana type potatoes;
(
c) carrots, beets and onions, the tops of which have not been
removed;
(
d) vegetables consigned to a plant, factory or other place for
canning, freezing or other processing or preservation;
(
e) vegetables sold by a producer directly to a consumer at a
farmers' market, the producer's farm or at another location.
Grades
3(1) Subject to subsections (3) and (4), the grades for fresh vegetables
and the standards for those grades are set out in
Schedule 1.
(2) Condition defects affect the grade of fresh vegetables and are to be
taken into account
(
a) at all times, for any lot of beets, cabbages, carrots, onions,
parsnips, potatoes or rutabagas, and
(
b) at the time of shipping or repacking, for any lot of other
vegetables.
(3) Subject to subsection (4), a tolerance of 5% in addition to the
tolerances provided in
Schedule 1 is allowed for condition defects but, in
the case of potatoes, not more than an additional 1% may be decay and, in
the case of the other vegetables, not more than an additional 2% may be
decay.
(4) The additional tolerance allowed under subsection (3) does not apply
to beets, carrots, onions, parsnips, potatoes or rutabagas at the time of
shipping or at the time of repacking.
Packages
4 The requirements with respect to packages for fresh vegetables are as
follows:
(
a) the package must be suitable for the vegetables;
(
b) if the vegetables are listed in
Schedule 2 and the vegetables
are prepackaged, the package must be of the size or weight set out in
column 2 of
Schedule 2;
(
c) if the vegetables are not listed in
Schedule 2 and the package
contains not more than 1.36 kg net weight, the package must be a
transparent package or other closed package that allows the vegetables to
be readily visible;
(
d) if the vegetables are visible in the package, the vegetables
that are visible must represent the grade, size, maturity, colour and
variety of the vegetables contained in the package;
(
e) the package must not be stained, soiled, warped, broken or
damaged so as to affect the shipping quality or marketability of the
vegetables;
(
f) if the package is a bag, the bag must be tightly and securely
closed;
(
g) if the package contains potatoes or onions, the package must be
new;
(
h) if the package is a bag that contains sweet corn, the bag must
be new and of open mesh type.
Inspection fees
5(1) The fees for an inspection of fresh vegetables are
(a) $68 or $0.60 per 100 kg of vegetables inspected, whichever is
the greater amount, if the inspection is performed at the shipping point,
(b) $68 or $1.17 per 100 kg of vegetables inspected, whichever is
the greater amount, if the inspection is performed at a place other than
the shipping point,
plus any amount under subsection (2).
(2) Reasonable travelling, telegram, telephone or other expenses incurred
in connection with the inspection of fresh vegetables are part of the
inspection fees.
Appeal inspection fees
6(1) The fee for an appeal inspection referred to in
section 18 of the
Vegetable Sales Regulation (AR 105/97) is the fee payable under
section 5.
(2) No fee is payable for an appeal inspection if the original inspection
is not confirmed.
Inspection certificate fee
7 The fee for additional copies of an inspection certificate under
section 24(2) of the Vegetable Sales Regulation (AR 105/97) is $2.
Expiry
8 For the purpose of ensuring that this Regulation is reviewed for
ongoing relevancy and necessity, with the option that it may be re-passed
in its present or an amended form following a review, this Regulation
expires on March 31, 2006.
SCHEDULE 1
GRADES AND GRADE STANDARDS
1 In this Schedule, where a grade is described as a "Canada" grade, the
standards for that grade are those set out in the Fresh Fruit and Vegetable
Regulations, C.R.C. 1978, c.285 under the Canada Agricultural Products
Standards Act.
Asparagus
2 The grades for asparagus are Canada No. 1, Canada No. 1 Slender and
Canada No. 2.
Beets
3 The grades for beets are Canada No. 1 and Canada No. 2.
Brussels sprouts
4 The grades for brussels sprouts are Canada No. 1 and Canada No. 2.
Cabbages
5 The grades for cabbages are Canada No. 1 and Canada No. 2.
Carrots
6(1) The grades for carrots are Canada No. 1, Canada No. 2 and Alberta No.
1 Small.
(2) Alberta No. 1 Small is the grade for carrots that meet the following
standards:
(
a) have similar varietal characteristics;
(
b) are not woody in texture, broken, soft, flabby or shrivelled;
(
c) are not trimmed into the crown but are so trimmed that the
length of the tops of 75% of the carrots does not exceed 13 mm and the
length of the tops of the remaining 25% of the carrots does not exceed 25
mm;
(
d) are not rough, forked or misshapen and not materially affected
by secondary rootlets;
(
e) are reasonably clean;
(
f) are free from sunburn that
(
i) extends more than 13 mm below the outer edge of the
crown, or
(ii) affects more than 10% of the carrots in the lot,
other than sunburn affecting only the crown and not extending downward from
the outer edge of the crown;
(
g) are free from decay;
(
h) are free from any injury or defect, other than an injury or
defect referred to in clauses (
b) to (g), that
(
i) materially affects their appearance, edibility or
shipping quality, or
(ii) cannot be removed without a loss of more than 5% of
the total weight of a carrot;
(
i) have a minimum length of 89 mm;
(
j) have a diameter that is not less than 13 mm and not greater
than 25 mm;
(
k) are properly packed.
Cauliflower
7 The grades for cauliflower are Canada No. 1 and Canada No. 2.
Celery
8 The grades for celery are Canada No. 1, Canada No. 1 Heart and Canada
No. 2.
Sweet corn
9 The grade for sweet corn is Canada No. 1.
Field cucumbers
10 The grades for field cucumbers are Canada No. 1 and Canada No. 2.
Greenhouse cucumbers
11 The grades for greenhouse cucumbers are Canada No. 1 and Canada No. 2.
Head lettuce
12 The grades for head lettuce are Canada No. 1 and Canada No. 2.
Onions
13 The grades for onions are Canada No. 1, Canada No. 1 Pickling and
Canada No. 2.
Parsnips
14(1) The grades for parsnips are Canada No. 1, Canada No. 2 and Alberta
No. 1 Small.
(2) Alberta No. 1 Small is the grade for parsnips that meet the following
standards:
(
a) have similar varietal characteristics;
(
b) are firm and not woody in texture;
(
c) are not trimmed into the crown but are so trimmed that the
length of the tops of 75% of the parsnips does not exceed 13 mm and the
length of the tops of the remaining 25% of the parsnips does not exceed 25
mm;
(
d) are fairly smooth;
(
e) are free from secondary rootlets that materially affect their
appearance;
(
f) are not turnip-shaped or so forked or misshapen as to
materially affect their appearance;

i) materially affects their appearance, edibility or
shipping quality, or
(ii) cannot be removed without a loss of 5% by weight of
a parsnip;
(
j) have a minimum length of 127 mm and a diameter that is not less
than 22 mm and not greater than 76 mm;
(
k) are properly packed.
Potatoes
15(1) The grades for potatoes are Canada No. 1, Canada No. 1 Large, Canada
No. 1 Creamer, Canada No. 2 and Alberta No. 1 Small.
(2) The standards for Alberta No. 1 Small Potatoes are the same as the
standards for Canada No. 1 Potatoes except that the Alberta No. 1 Small
Potatoes have a diameter that is not less than 25 mm and not greater than
57 mm.
Rutabagas
16 The grade for rutabagas is Canada No. 1.
Field tomatoes
17 The grades for field tomatoes are Canada No. 1, Canada No. 2, Canada
No. 1 Picklers and Canada No. 2 Picklers.
Greenhouse tomatoes
18 The grades for greenhouse tomatoes are Canada No. 1, Canada Commercial
and Canada No. 2.
