Government Process Simplification Act

(Ministry of Economic Development, Trade

and Tourism), 1996

EXPLANATORY NOTE

The Bill amends four statutes that fall under the administration of the Ministry of Economic Development, Trade and Tourism. The general purpose of the Bill is to simplify government processes and improve efficiency. Most of the changes are

made to eliminate the need to pass regulations to establish fees or prescribe forms.

Historical Parks Act (section 1 of the Bill)

The amendments to the Historical Parks Act allow fees to be established by the Minister without a regulation.

The amendment to

section 4 of the Act eliminates the existing regulation-making authority dealing with fees. The power to establish fees is in the new

section 5 of the Act.

Ontario Place Corporation Act (section 2 of the Bill)

The amendments to the Ontario Place Corporation Act allow fees to be established by the Ontario Place Corporation (with the approval of the Minister) without a regulation.

The power to establish the fees is in the new clause (

e) that is added to subsection 9 (1) of the Act. The repeal of clause 10 (

c) of the Act eliminates the existing regulation-making power dealing with fees.

St. Clair Parkway Commission Act (section 3 of the Bill)

The amendments to the St. Clair Parkway Commission Act allow fees to be established by the St. Clair Parkway Commission (with the approval of the Minister) without a regulation.

The power to establish the fees is in the new

section 3.1 of the Act. The repeal of clause 20 (1) (

c) of the Act and the amendment of clause 20 (1) (

d) of the Act eliminate the existing regulation-making powers dealing with fees.

Tourism Act (section 4 of the Bill)

The amendments to the Tourism Act allow fees to be established by the Minister without a regulation. They also allow forms to be approved by the Minister rather than prescribed by regulation.

The repeal of clauses 16 (1) (

c) and (

j) of the Act eliminates the regulation-making powers relating to fees and forms. The power to establish fees is in the new

section 10.1 of the Act. The new subsection (1.1) which is added to

section 16 of

the Act clarifies that regulations may require the use of forms approved by the Minister. The other amendments to the Act change the references to "prescribed fees" and "prescribed forms" because the fees and forms will no longer be prescribed.

The amendment to subsection 3 (2) of the Act also clarifies that a person is not entitled to a permit unless any permit fee that may be established is paid.

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

HISTORICAL PARKS ACT

(1) Section 4 of the Historical Parks Act is amended by inserting "(other than clauses 21 (1) (

o) and (q))" after "21" in the second line.

(2) The Act is amended by adding the following section:

Fees

(1) The Minister may establish fees for entrance into a historical park, for licences and permits and for any services and facilities provided in relation to the park.

Fees may vary

(2) The fees established by the Minister may vary between historical parks.

ONTARIO PLACE CORPORATION ACT

2. (1) Subsection 9 (1) of the Ontario Place Corporation Act is amended by adding the following clause:

(

e) to establish fees, subject to the approval of the Minister, for entrance into Ontario Place and in connection with any service or facility provided in Ontario Place.

(2) Clause 10 (

c) of the Act is repealed.

ST. CLAIR PARKWAY COMMISSION ACT

(1) The St. Clair Parkway Commission Act is amended by adding the following section:

Power to establish fees

3.1 The Commission may establish, subject to the approval of the Minister, fees for entrance into the Parks, for permits and for any services and facilities provided in relation to the Parks.

(2) Clause 20 (1) (

c) of the Act is repealed.

(3) Clause 20 (1) (

d) of the Act is amended by striking out "and prescribing fees for such permits" at the end.

TOURISM ACT

4. (1) Subsection 3 (1) of the Tourism Act is amended by striking out "in the prescribed form" in the fifth line.

(2) Subsection 3 (2) of the Act is amended by inserting after "upon" in the fifth line "paying the fee established by the Minister and".

(3) Clause 3 (2) (

a) of the Act is amended by striking out "in the prescribed form" and substituting "in a form approved by the Minister".

(4) Subsection 4 (1) of the Act is amended by striking out "in the prescribed form" in the third line.

(5) Subsection 4 (2) of the Act is amended by striking out "in the prescribed form" in the third and fourth lines and substituting "in a form approved by the Minister" and by striking out "the prescribed fee" at the end and substituting

"the fee established by the Minister".

(6) Subsection 6 (1) of the Act is amended by striking out "in the prescribed form" in the fourth line and substituting "in a form approved by the Minister" and by striking out "the prescribed fee" at the end and substituting "the fee

established by the Minister".

(7) Subsection 6 (3) of the Act is amended by striking out "the prescribed fee" in the fourth and fifth lines and substituting "the fee established by the Minister".

(8) Section 8 of the Act is amended by striking out "the prescribed form and payment of the prescribed fee" in the seventh and eighth lines and substituting "a form approved by the Minister and payment of the fee established by the

Minister".

(9) The Act is amended by adding the following section:

Establishment of fees

10.1 The Minister may establish fees in respect of the issuance of permits and licences and the renewal or transfer of licences.

(10) Clauses 16 (1) (

c) and (

j) of the Act are repealed.

(11) Section 16 of the Act is amended by adding the following subsection:

Forms

(1.1) A regulation made under subsection (1) may provide for the use of forms approved by the Minister.

Commencement

5. This Act comes into force on a day to be named by proclamation of the Lieutenant Governor.

Short title

6. The

short title of this Act is the Government Process Simplification Act (Ministry of Economic Development, Trade and Tourism), 1996.
