B.C. Reg. 213/2006, deposited July 13, 2006, pursuant to the PLANT PROTECTION ACT [Section 8]. Order in Council 493/2006, approved and ordered July 13, 2006.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Balsam Woolly Adelgid Regulation, B.C. Reg. 414/92, is amended according to the attached Schedule.

Schedule

1 The Balsam Woolly Adelgid Regulation, B.C. Reg. 414/92, is amended in

section 1

(

a) in the definition "log", by adding "but without

branches" after "with any attached bark", and

(

b) by repealing the definition "quarantine zone" and

substituting the following:

"quarantine area" means the area described in the Appendix; .

Section 2 is amended

(

a) in subsection (1) by striking out "Ministry of Agriculture

and Food" and substituting "Ministry of Agriculture and Lands",

and

(

b) in subsection (2) by striking out "Minister of

Agriculture, Fisheries and Food" and substituting "Minister of

Agriculture and Lands".

Section 3 is repealed and the following substituted:

Prohibition on movement

(1) A person must not move any tree of Abies spp. that originated in the quarantine area to any place in British Columbia outside the quarantine area.

(2) Despite subsection (1), a person may move logs of

Abies spp. out of the quarantine area if the logs are transported and stored in water and promptly processed.

Section 7 is repealed and the following substituted:

Powers of inspectors

7 Inspectors either defined under the Provincial Plant Protection Act or designated under the

Plant Protection Act (Canada) are empowered to enforce the provisions of this regulation.

5 Appendix A is repealed and the following substituted:

Appendix

Quarantine Area

The forest districts listed below, established under the Forest Regions and Districts Regulation, B.C. Reg. 123/2003, constitute a quarantine area for the purposes of

section 8 (2) (

f) of the

Plant Protection Act.

Campbell River forest district (Coast forest region)

Chilliwack forest district (Coast forest region)

North Island-Central Coast forest district (Coast forest region)

South Island forest district (Coast forest region)

Squamish forest district (Coast forest region)

Sunshine Coast forest district (Coast forest region)
