LOCAL GOVERNMENT AMENDMENT ACT, 2017

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

This Bill will ensure that municipalities in B.C. cannot be incorporated without ensuring that there are first residents actually living in the area at the time of incorporation.

Section 8 of the Local Government Act, R.S.B.C. 2015, c. 1, is amended by

(

a) repealing subsection (3),

(

b) in subsection (4) by striking out " or (3) ",

(

c) by repealing subsections (5) and (6),

(

d) in subsection (7), by striking out " and unless the letters patent for a mount resort municipality incorporated under subsection (6) provide otherwise, " and

(

e) in subsection (7) (

a) by striking out " under that subsection ".

Explanatory Note

This Bill will ensure that municipalities in B.C. cannot be incorporated without ensuring that there are first residents actually living in the area at the time of incorporation.
