B.C. Reg. 53/2015 , deposited March 30, 2015, under the LIQUOR CONTROL AND LICENSING AMENDMENT ACT, 2014 [section 48] and the LIQUOR CONTROL AND LICENSING ACT [section 84]. Order in Council 136/2015, approved and ordered March 27, 2015.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that
(
a) section 1 (j), as it repeals the definition of “store manager” , and sections 3, 4 (
a) to (f), 5, 17 (b), 26 and 31 (
f) and (
l) of the Liquor Control and Licensing Amendment Act, 2014 , S.B.C. 2014, c. 13, are brought into force, and
(
b) the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended as set out in the attached Schedule.

Schedule
Section 1 (1) of the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended in the definition of “public special occasion”
(
a) by striking out “jurisdiction, for which event, ” and substituting “ jurisdiction; ”, and
(
b) by repealing paragraphs (
a) to (c).
2 Sections 2 and 3 are repealed.
Section 15 is amended
(
a) by repealing subsections (1) and (2) and substituting the following:
(2) A special occasion licence may not be issued under
section 7 of the Act unless
(
a) the licence is for an event described in the definition of “private special occasion” or “public special occasion” in
section 1 (1) of this regulation, and
(
b) the licence specifies
(
i) the days and hours during which liquor may be sold or served under the licence,
(ii) the maximum quantity of liquor that may be sold or served under the licence, and
(iii) the maximum retail prices at which liquor may be sold or served under the licence. ,
(
b) by repealing subsections (4) and (5),
(
c) by repealing subsection (8) and substituting the following:
(8) A person may advertise liquor or the availability of liquor in an advertisement or other promotion of a public special occasion.
(8.1) Subject to subsection (8.2), sections 56 and 57 do not apply in relation to advertising under subsection (8) of this section.
(8.2) Section 57 (4) applies to advertising under subsection (8) of this section. ,
(
d) in subsection (9) by striking out “ If an event for which a special occasion licence is to be issued ” and substituting “ Before applying for a special occasion licence for an event that ” and by striking out “ must, before issuance of the licence, produce ” and substituting “ must receive ”,
(
e) by adding the following subsections:
(9.1) A person who holds a special occasion licence for a special occasion for which written permission is required under subsection (9) must produce the written permission on request of the general manager.
(9.2) A person who holds a special occasion licence must, whenever liquor is sold or served under the licence, keep at the site of the special occasion, and produce on request of the general manager or a peace officer,
(
a) the licence,
(
b) a copy of the licence application and any records submitted with the licence application,
(
c) any written permission required under subsection (9) for the special occasion, and
(
d) records of the liquor purchased for sale or service under the licence. , and
(
f) in subsection (11) by striking out “ or to a delegate of the general manager ”.
Section 17 is amended
(
b) in subsection (2) by striking out “ In addition to the requirements under
section 34, a person who holds a winery licence must make available for inspection, at the request of the general manager or his or her designate, records of the following information as applicable: ” and substituting “ The records described in subsection (1) include, without limitation, any of the following that are applicable to the winery: ”, and
(
c) by repealing subsection (3).
Section 31 is amended
(
b) by repealing subsection (2).
Section 34 is amended
(
b) by repealing subsection (2) and substituting the following:
(
a) catering authorizations issued to the caterer;
(
b) records that, under
section 89 (2) (
c) of the Act, accompanied any application by the caterer for a catering authorization;
(
c) catering contracts entered into by the caterer.
