On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective October 17, 2018,

(

a) the Park, Conservancy and Recreation Area Regulation, B.C. Reg. 180/90, is amended as set out in the attached Appendix 1, and

(

b) the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended as set out in the attached Appendix 2.

Appendix 1

1 The Park, Conservancy and Recreation Area Regulation, B.C. Reg. 180/90, is amended by adding the following section:

Tobacco and e-cigarettes

11.1

(1) In this section, “activated e‑cigarette” , “e‑cigarette” and “tobacco” have the same meaning as in the Tobacco and Vapour Products Control Act .

(2) A person must not smoke tobacco, hold lighted tobacco, use an e‑cigarette or hold an activated e‑cigarette in a park, conservancy or recreation area except

(

a) in an area as permitted by a sign or other device, or

(

b) as authorized by a park officer.

Appendix 2

Schedule 2 of the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended under the heading “ Park, Conservancy and Recreation Area Regulation, B.C. Reg. 180/90 ” by adding the following items as indicated:
