OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works, dated January 16, 2024, and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and

Section 80 of

Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act, is pleased to: (

a) extinguish the right of the public to use that portion of the public highway, identified as Parcels 23-A and 23-B containing a combined area of 869.8 square metres (0.215 acres), located at or near South River Loop, Lower South River, Antigonish County, more particularly described in

Schedule “A” and as shown on

Schedule “B” attached to and forming part of the Report and Recommendation; (

b) authorize the conveyance of the parcels of surplus land, Parcels 23-A and 23-B, to Donald and Janice Landry, both of Lower South River, Antigonish County, for the consideration of $1,612.50 plus HST of $241.88 for a total purchase price of $1,854.38; (

c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands herein above described; and (

d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
