An Act to Amend the Fish and Wildlife Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 114 of the Fish and Wildlife Act, chap- ter F-14.1 of the Acts of New Brunswick, 1980, is amended (

a) in paragraph (

b) by striking out the semi- colon at the end of the paragraph and substitut- ing a period; (

b) by repealing paragraph (c). 2

Section 114.1 of the Act is amended (

a) by adding before subsection (1) the follow- ing: 114.1(0.1) The Minister may appoint persons, who, in his or her opinion, have received suitable training to be qualified technicians for the purposes of this section. (

b) by repealing subsection (1) and substitut- ing the following: 114.1(1) The Lieutenant-Governor in Council may by regulation prescribe the procedures to be PROJET DE LOI 4 Loi modifiant la

a) par l’adjonction, avant le paragraphe (1), de ce qui suit : 114.1(0.1) Le Ministre peut, aux fins du présent article, nommer des personnes qui, à son avis, ont la formation requise pour être des techniciens quali- fiés.

b) par l’abrogation du paragraphe (1) et son remplacement par ce qui suit : 114.1(1) Le lieutenant-gouverneur en conseil peut prescrire par règlement le s procédés qu’un techni-

Loi sur le poisson et la faune used by a qualified technician in the analysis or ex- amination of the following: (

a) a portion of meat, tissue or body fluid of any species of wildlife or fish; (

b) a firearm; (

c) ammunition; (

d) a substance; and (

e) any other thing prescribed by regulation. (

c) by repealing subsection (2) and substitut- ing the following: 114.1(2) Subject to subsections (3) and (4), a cer- tificate of a qualified technician stating that the qualified technician has, in accordance with a pro- cedure prescribed by regulation, analyzed or exam- ined any of the things listed in paragraphs (1)(

a) to (

e) and stating the result of the qualified technician’s analysis is admissible in evidence in a prosecution with respect to an offence under this Act or the reg- ulations and, in the absence of evidence to the con- trary, is proof of the statements contained in the cer- tificate without proof of the appointment, authority or signature of the person purporting to have signed the certificate. 3 Subsection 118(1) of the Act is amended by adding after paragraph (aa) the following: (aa.01) prescribing any other thing for the pur- poses of

a) à

e) et indi- quant le résultat de l’analyse ou de l’examen, est ad- missible en preuve dans toute poursuite pour infrac- tion à la présente loi ou aux règlements et, en l’absence de preuve contraire, fait foi des affirma- tions qui y sont contenues sans qu’il soit nécessaire de prouver l’authenticité de la nomination, de l’autorité ou de la signature de la personne qui est présumée l’avoir signé. 3 Le paragraphe 118(1) de la Loi est modifié par l’adjonction, après l’alinéa aa), de ce qui suit : aa.01) prescrivant toute autre chose aux fins de l’article 114.1;

Section 1 (

a) and (

b) The existing provision is as follows: 114 The Minister may (

a) offer a reward, not exceeding five hundred dollars, for information leading to the apprehension and conviction of any person violating any of the provisions of this Act; (

b) order that the amount of such reward be paid to the per- son entitled thereto out of the Consolidated Fund; (

c) appoint persons, who in his opinion, have received suit- able training, to be qualified technicians for the purpose of determining the identity by species of a portion of meat, tis- sue or body fluid.

Section 2 (

a) New provision. (

b) The existing provision is as follows: 114.1(1) The Lieutenant-Governor in Council may by regula- tion prescribe the procedures to be used by a qualified technician appointed by the Minister under paragraph 114(

c) in order to de- termine the identity by species of any meat, tissue or body fluid. (

c) The existing provision is as follows: 114.1(2) In a prosecution or proceeding under this Act in which proof is required with respect to the identity by species of any meat, tissue or body fluid, a certificate of a qualified techni- cian appointed by the Minister under paragraph 114(c) (

a) stating that he or she has analyzed a portion of meat, tissue or body fluid utilizing a procedures prescribed by reg- ulation, and (

b) stating the result of his analysis is, in the absence of evidence to the contrary, proof of the iden- tity by species of the portion of meat, tissue or body fluid ana- lyzed and of the facts stated in the certificate, without proof of the appointment, signature or authority of the person appearing to have signed the certificate.

Article 1

b) ordonner que le montant de la récompense versée à la personne qui y a droit soit prélevé sur le Fonds consolidé;

c) nommer des personnes qui, à son avis, ont la formation requise pour être des techniciens qualifiés en vue d’établir l’identité d’une espèce à partir d’un prélèvement de chair, de tissu ou de sécrétion.

Article 2

a) Nouvelle disposition.

b) La disposition actuelle se lit comme suit : 114.1(1) Le lieutenant-gouverneur en conseil peut prescrire par règlement les procédés qu’un technicien qualifié nommé par le Ministre en vertu de l’alinéa 114c) doit utiliser et suivre en vue d’établir l’identité d’une espèce à partir d’un prélèvement de chair, de tissu ou de sécrétion.

c) La disposition actuelle se lit comme suit : 114.1(2) Lorsqu’il est nécessaire dans une poursuite ou ins- tance en vertu de la présente loi de prouver l’identité d’une es- pèce à partir d’un prélèvement de chair, de tissu ou de sécrétion, un certificat d’un technicien qualifié nommé par le Ministre en vertu de l’alinéa 114c)

a) déclarant qu’il a analysé un prélèvement de chair, de tissu ou de sécrétion en utilisant un procédé prescrit par rè- glement, et

b) donnant les résultats de l’analyse qu’il a faite, fait foi, sauf preuve contraire, de l’appartenance du prélèvement de chair, de tissu ou de sécrétion analysé à l’espèce qui y est in- diquée ainsi que des énonciations qui y figurent sans qu’il soit nécessaire de prouver l’authenticité de la signature qui y est ap- posée, la nomination ou les pouvoirs du signataire.

Article 3 Un pouvoir de réglementation est ajouté.
