Reduction (M.O. 7/2023) on September 23, 2023 pursuant to

section 12(1)(

b) and (

d) of

Schedule 12 of the Government Organization Act.

1 The Registry Service Charges Regulation (AR 183/2005)

is amended by this Regulation.

Section 2.1 is amended

(

a) by repealing subsection (3);

(

b) in subsection (4)

(

i) by striking out "commencing on April 1, 2021";

(ii) by repealing clauses (a), (

c) and (e).

Section 4 is amended by striking out "September 30, 2024"

and substituting "September 30, 2028".

Marketing of Agricultural Products Act

ALBERTA CANOLA PRODUCERS MARKETING

AMENDMENT REGULATION

Council on September 21, 2023 pursuant to

section 26 of the Marketing of

Agricultural Products Act and

section 9 of the Alberta Canola Producers Marketing

Plan Regulation (AR 109/2023).

1 The Alberta Canola Producers Marketing Regulation

(AR 142/98) is amended by this Regulation.

Section 4(3)(

d) is repealed and the following is

substituted:

(

d) the identification number assigned to the producer by the

dealer, if available.

Section 5 is amended

(

a) by repealing subsection (1) and substituting the

following:

(1) A service charge paid by or on behalf of a producer is

refundable to the producer on request of the producer in

accordance with this section.

(

b) by repealing subsection (2)(b)(vi) and substituting

the following:

(vi) any other information requested by the Commission.

(

c) in subsection (3)

(

i) by striking out "Requests for refunds" and

substituting "A request for a refund";

(ii) by striking out "head office" and substituting

"office";

(iii) in clauses (

a) and (

b) by striking out "service

charges" and substituting "a service charge".

(

d) by repealing subsections (4), (5) and (6) and

substituting the following:

(4) Subject to subsection (5), a request for a refund that does

not comply with subsections (2) and (3) shall not be

considered by the Commission and the producer is not

entitled to a refund in respect of the service charge in

question.

(5) The Commission may consider a request for a refund that

does not comply with subsections (2) or (3) if the

Commission is satisfied that extenuating circumstances exist

that warrant it doing so and may

(

a) refund the service charge in question, or

(

b) refuse to refund the service charge in question.

(6) The Commission must refund the service charge to the

producer

(

a) within 90 days after the end of August, if the

request complies with subsection (2) and was

received in accordance with subsection (3)(a),

(

b) within 90 days after the end of February, if the

request complies with subsection (2) and was

received in accordance with subsection (3)(b), or

(

c) within 90 days after receipt of the request, if the

request was considered and the service charge is to

be refunded under subsection (5).

Section 7(2)(

c) is repealed and the following is

substituted:

(

c) any other information requested by the Commission.

Section 13(5)(

b) is amended by striking out "(AR 84/2012)"

and substituting "(AR 199/2016)".

Section 22 is amended by striking out "May 31, 2024" and

substituting "May 31, 2030".
