1 The School Transportation Regulation (AR 102/2017) is

amended by this Regulation.

Section 6(5) is amended by striking out "section 5" and

substituting "section 4".

APPEAL RULES AMENDMENT REGULATION

section 49 of the Apprenticeship and Industry

Training Act.

1 The Appeal Rules Regulation (AR 58/99) is amended by

this Regulation.

Section 2(2), (3) and (4) are repealed and the following is

substituted:

(2) Notwithstanding

section 43(

c) of the Act and this Regulation, a

refusal by the Executive Director to register a contract of

apprenticeship on or after the date on which the designation of the

trade to which the contract relates is rescinded, or the branch of the

trade to which the contract relates is repealed, is not subject to

appeal.

Section 19 is repealed.

1 The Gasfitter Trade Regulation (AR 279/2000) is amended

by this Regulation.

Section 2(2) is amended

(

a) in clause (

a) by striking out "gasfitter (A)" and

substituting "gasfitter - Class A";

(

b) in clause (

b) by striking out "gasfitter (B)" and

substituting "gasfitter - Class B".

3 The heading after

section 4 is amended by striking out

"Gasfitter (A)" and substituting "Gasfitter - Class A".

Section 5 is amended by striking out "gasfitter (A)" and

apprentice, subject to the Sheet Metal Worker

Trade Regulation (AR 303/2000), to carry out any

of the undertakings that constitute the

gasfitter - Class B branch of the trade.

Section 10(1) and (2) are amended by striking out

"gasfitter (A)" and substituting "gasfitter - Class A".

10 The heading after

section 10 is amended by striking out

"Gasfitter (B)" and substituting "Gasfitter - Class B".

Section 11 is amended by striking out "gasfitter (B)" and

substituting "gasfitter - Class B".

15 The following is added after

section 14:

Apprenticeship re sheet metal worker

14.1(1) Where a person

(

a) is an apprentice in an apprenticeship program under the

Sheet Metal Worker Trade Regulation (AR 303/2000),

and

(

b) does not hold a trade certificate in the gasfitter - Class A

branch of the trade or the gasfitter - Class B branch of

the trade,

that person is deemed to be an apprentice in the apprenticeship

program for the gasfitter - Class B branch of the trade.

(2) Notwithstanding

section 13, a person who is an apprentice in

an apprenticeship program for the trade of sheet metal worker is

deemed to have acquired the necessary hours of on the job training

and successfully completed the technical training that is required

or approved by the Board for the gasfitter - Class B branch of the

trade if that person acquires under the apprenticeship program for

the trade of sheet metal worker the number of hours and

successfully completes the technical training that is attributable to

the training of a gasfitter - Class B under the apprenticeship

program for the trade of sheet metal worker.

Section 16 is amended

(

a) in subsections (1) and (2) by striking out "gasfitter

(B)" wherever it occurs and substituting

"gasfitter - Class B";

(

b) in subsection (3)

(

i) by striking out "gasfitter (B)" wherever it occurs

and substituting "gasfitter - Class B";

(ii) in clause (

a) by striking out "gasfitter (A)" and

substituting "gasfitter - Class A" and by striking

out "or" at the end of clause (a);

(iii) by adding ", or" at the end of clause (

b) and by

adding the following after clause (b):

(

c) with respect to a person who is an apprentice in

the gasfitter - Class B branch of the trade by virtue

of being an apprentice in an apprenticeship

program in the trade of sheet metal worker, may

employ that apprentice, subject to the Sheet Metal

Worker Trade Regulation (AR 303/2000), to carry

out any of the undertakings that constitute the

gasfitter - Class B branch of the trade.

Section 17 is amended

(

a) in subsections (1), (2) and (3) by striking out

"gasfitter (B)" and substituting "gasfitter - Class B";

(

b) in subsection (1) by striking out "(2) or (3)" and

substituting "(2), (3) or (3.1)";

(

c) by adding the following after subsection (3):

(3.1) Notwithstanding subsection (2), with respect to a person

who is an apprentice in the gasfitter - Class B branch of the

trade by virtue of being an apprentice in the apprenticeship

program for the trade of sheet metal worker, a person

employing that apprentice must pay wages to that apprentice in

accordance with the Sheet Metal Worker Trade Regulation

(AR 303/2000).

18 This Regulation comes into force on September 1, 2017.

occurs and substituting "1560".

2(1) The Auto Body Technician Trade Regulation

(AR 161/2008) is amended by this section.

(2) Section 7 is amended

substituting "1590".

(3) Section 12 is amended

(

a) in subsection (2) by striking out "1600" and

(4) Sections 17(2) and (3) and 22(2) are amended by striking

3(1) The Electrician Trade Regulation (AR 274/2000) is

amended by this section.

4(1) The Electric Motor Systems Technician Trade

Regulation (AR 273/2000) is amended by this section.

(2) Section 3(ll) is repealed and the following is substituted:

(ll) repairing and verifying certification of electrical equipment

and components used in hazardous locations;

(3) Section 4 is amended by striking out "1500" wherever it

occurs and substituting "1560".

(4) The heading before

5(1) The Power System Electrician Trade Regulation

(AR 297/2000) is amended by this section.

(2) Section 4 is amended

(

a) in subsections (2) and (3) by striking out "1500" and

substituting "1560".

(3) The heading before

section 7 is amended by striking out

6(1) The Sheet Metal Worker Trade Regulation

(AR 303/2000) is amended by this section.

(2) Section 1 is amended

(

a) by adding the following after clause (c):

(c.1) "heating system" means a system for heating and

circulating air inside a building using a gas fired

appliance;

(

b) by adding the following after clause (f):

(g) "ventilation system" means a system for exchanging air

inside a building with fresh outside air and circulating

air within a building;

(h) "venting system" means a system for exhausting

combustion gases to the outside of a building and

supplying air for combustion by heating systems.

(3) Section 2(b)(ii) is amended by striking out "and

ventilation" and substituting "systems, ventilation systems and

venting".

(4) Section 3 is amended

(

a) by adding the following after clause (d):

(d.1) laying out, preparing, assembling and installing venting

systems and pre-fabricated components of venting

systems;

(

b) by repealing clause (

e) and substituting the

following:

(

e) installing, maintaining and repairing

(

i) furnaces,

(ii) combination rooftop units,

(iii) make-up air units,

(iv) heat recovery and indoor air quality systems,

(

v) heating systems,

(vi) ventilation systems,

(vii) air conditioning systems of up to 5 tons total

capacity per system,

(viii) appliances, and

(ix) accessories to any item listed in subclauses (

i) to

(viii) and equipment similar to any item listed in

subclauses (

i) to (viii) related to or used for sheet

metal work;

(

c) by repealing clause (

f) and substituting the

following:

(

f) carrying out the following servicing on electrical

components of heating systems, ventilation systems and

air conditioning systems, along with the associated

connection and disconnection of de-energized electrical

supply circuits of the systems:

(

i) servicing or changing controls, contactors and

motors;

(ii) repairing burnt or broken wires;

(iii) making minor upgrades of controls to existing

heating systems, ventilation systems and air

conditioning systems;

(5) Section 4 is amended by striking out "1425" wherever it

occurs and substituting "1500".

(6) The heading before

section 7 is amended by striking out

(7) Section 9 is repealed.
