B.C. Reg. 98/2006, deposited April 27, 2006, pursuant to the HEALTH ACT [Sections 1 and 8 (1) (

d) and (2) (f)]. Order in Council 294/2006, approved and ordered April 27, 2006.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the West Nile Virus Control Regulation, B.C. Reg. 357/2004, is amended

(

a) in

section 1 by repealing the definition of "Pesticide Use Permit"

and substituting the following:

"pesticide use authority" means

(

a) a licence issued under

section 4 of the Integrated Pest Management Act ,

(

b) a permit issued under

section 6 of the Integrated Pest Management Act ,

(

c) a pest management plan and a pesticide use notice prepared, and a confirmation received, under

section 7 of the

Integrated Pest Management Act , or

(

d) any other record under the Integrated Pest Management Act

that authorizes the Minister of Health to use pesticide products for the purpose of controlling mosquito species in areas of British Columbia where there is a risk to human health from West Nile Virus. ,

(

b) in sections 3 (2) (

c) and (

d) and 4 (2) by striking out "the Pesticide Use Permit" and substituting "a pesticide use authority", and

(

c) by repealing

section 4 (1) (

b) and (

c) and substituting the following:

(

b) comply with any conditions set out under

section 3 (2) (c), and

(

c) provide to the person who issued the order any information or assistance required by that person to comply with any other conditions of the pesticide use authority.
