Section 1 of the Essential Services in Nursing Homes Act,

chapter E-10.5 of the Acts of New Bruns- wick, 2009, is amended by adding the following defini- tion in alphabetical order: 1 L’article 1 de la

6.1(2) At any time during negotiations to reach an es- sential services agreement, an employer or bargaining agent may make a complaint in writing to the Board that the other party has failed to comply with subsection (1), and the Board shall inquire into the complaint. 6.1(2) À tout moment pendant les négociations en vue de conclure un accord sur les services essentiels, l’em- ployeur ou l’agent négociateur peut déposer une plainte écrite auprès de la Commission alléguant la non- conformité de l’autre

6.2(6) If the employer and the bargaining agent do not reach an essential services agreement with the assistance of the mediator, the Board shall act under

Section 7 of the Act is repealed and the following is substituted: 8 L’article 7 de la Loi est abrogé et remplacé par ce qui suit : 7 If an employer and a bargaining agent are able to reach an essential services agreement within the time limits established under subsection 6(1), the terms of the agreement shall be jointly communicated by the parties to the Board and the Board shall issue an order without delay in accordance with those terms. 7 S’ils concluent un accord sur les services essentiels dans les délais impartis en vertu du au paragraphe 6(1), l’employeur et l’agent négociateur communiquent con- jointement les modalités de cet accord à la Commission, et cette dernière rend sans délai une ordonnance con- forme à ces modalités. 9 The heading “Agreement not reached” preceding

Section 11 of the Act is repealed and the following is substituted: 15 L’article 11 de la Loi est abrogé et remplacé par ce qui suit : 11 The Board shall inform all employees in a bargain- ing unit who are employed in positions that are identi- fied as designated positions in an order issued under sec- tion 7, 8 or 9 of the order within the time and in the manner that the Board determines. 11 La Commission informe, dans le délai qu’elle im- partit et de la manière qu’elle détermine, tous les em- ployés d’une unité de négociation occupant des postes précisés dans l’ordonnance rendue en application de l’ar- ticle 7, 8 ou 9 comme étant des postes désignés. 16

section 8 or subsection 9(4) considers that the level of service to be maintained by the bargaining unit to provide essential services has the effect of substantially interfering with a meaningful collective bargaining process, the bargaining agent or employer, as the case may be, may apply to the Board for an order providing for binding arbitration as a dis- pute mechanism between the parties. 13.1(1) Si l’employeur ou l’agent négociateur lié par une ordonnance rendue en application de l’article 8 ou du paragraphe 9(4) estime que le niveau de service que doit maintenir l’unité de négociation afin d’assurer la fourniture des services essentiels constitue un entrave substantielle au droit à un processus véritable de négo- ciation collective, l’un ou l’autre peut demander à la Commission de rendre une ordonnance prévoyant que le mode de règlement des différends entre les parties sera l’arbitrage obligatoire. 13.1(2) An application referred to in subsection (1) shall be made by written notice to the Board and to the other party within 30 days after the date the Board pro- vides the employer and the bargaining agent a copy of the order issued under

section 8 or subsection 9(4), as the case may be. 13.1(2) La demande visée au paragraphe (1) est pré- sentée à la Commission et à l’autre

c) de tout autre facteur qu’elle estime pertinent. 13.1(5) If the Board determines that the level of serv- ice to be maintained by the bargaining unit to provide es- sential services has the effect of depriving the parties of a meaningful collective bargaining process, the Board shall issue an order that if, after bargaining collectively, the parties fail to conclude a collective agreement or the renewal or revision of an existing collective agreement, all matters remaining in dispute between them shall be settled by binding arbitration in accordance with the In- dustrial Relations Act and

b) as the secondary factor, the wages of other unionized private sector employees in New Bruns- wick and non-unionized private sector employees in New Brunswick performing the same or similar func- tions in the same or similar circumstances as the em- ployees in the bargaining unit, considering the entire compensation package including, but not limited to, retirement plans or pensions, medical and dental ben- efits, life insurance and disability insurance, shift pre- miums, bonuses and paid time off; and
