EXPLANATORY NOTES

This Bill would amend the Pharmaceutical Services Act to

clarify that a pharmacist or

dispensing physician is authorized to dispense a controlled drug where the

prescription for the controlled drug is received by telephone and the Controlled

Drugs and Substances Act (Canada), the regulations under that Act or an

exemption issued under that Act authorizes a pharmacist or dispensing physician

to dispense the controlled drug where the prescription is received by telephone;

clarify that the use of a

tamper resistant prescription pad is not required for a prescription for a

controlled drug where the prescription is transferred from another pharmacist

or dispensing physician and the Controlled

Drugs and Substances Act

(Canada), the regulations under that Act or an exemption issued under that Act authorizes the pharmacist or dispensing physician to dispense the controlled

drug where the prescription for the controlled drug is transferred from another

pharmacist or dispensing physician;

no longer require the use of a tamper

resistant prescription pad where the prescription for a controlled drug is

delivered directly from the prescriber to the pharmacy dispensing the drug; and

no longer require the use of a

tamper resistant prescription pad where the pharmacist or dispensing physician

substitutes a prescribed controlled drug with another controlled drug that has

an equivalent therapeutic effect.

Tamper resistant prescription drug pads

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

1. (1) Subsections 26(5) and (5.1) of the Pharmaceutical

Services Act are repealed and the following substituted:

(5) Drugs

listed under subsection (2), the prescription of which requires the use of

tamper resistant prescription drug pads, shall not be dispensed where the

prescription is received by telephone.

(5.1) Notwithstanding

subsection (5), a pharmacist or dispensing physician may dispense a drug

included in the list established under subsection (2) where the prescription is

received by telephone and the Controlled Drugs and Substances Act

(Canada), the regulations under that Act or an exemption issued under that Act

authorizes a pharmacist or dispensing physician to dispense the drug where the

prescription for the drug was received by telephone.

(2) Subsection 26(6.1) of the Act is repealed and

the following substituted:

(6.1) Notwithstanding subsection (6), a pharmacist

or dispensing physician may dispense a drug included in the list established

under subsection (2) that is not prescribed using a tamper resistant

prescription drug pad where one of the following apply:

(

a) the

prescription for the drug is transferred from another

pharmacist or dispensing physician and the Controlled Drugs and Substances Act (Canada), the regulations under that Act or an exemption issued under

that Act authorizes a pharmacist or dispensing

physician to dispense the drug where the prescription is transferred from

another pharmacist or dispensing physician;

(

b) the prescription for the drug is sent directly

from the prescriber to the pharmacy dispensing the drug; or

(

c) the pharmacist or dispensing physician

substitutes the prescribed drug included in the list established under

subsection (2) with another drug that has an equivalent therapeutic effect as

the prescribed drug.

(3) Subsection 26(6.2) of the Act is repealed.
