HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the

Province of British Columbia, enacts as follows:

1 The following

section is added to the Medical Practitioner's

Act, R.S.B.C. 1996, c. 285:

Use of Complementary Therapies

89.1 A registered practitioner shall not be found guilty of unprofessional

conduct or be found to be incapable or unfit to practice medicine or osteopathy solely on

the basis that the registered practitioner employs a therapy that is non-traditional or

departs from prevailing medical practices, unless it can be demonstrated that the therapy

has a safety risk for the patient unreasonably greater than the prevailing treatment.

Commencement

2 This Act comes into force by regulation of the

Lieutenant Governor in Council.

Explanatory Note

with the Declaration of Helsinki, signed by Canada, and within the stated guideline,

allows a member of the college to use new and/or non-traditional treatments.
