An Act to Amend the Forest Products Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 3 of the Forest Products Act,

chapter F-21 of the Revised Statutes, 1973, is amended (

a) in subsection (1) (

i) by repealing paragraph (d); (ii) in paragraph (

e) by striking out “one mem- ber” and substituting “two members”; (

b) by repealing subsection (2) and substituting the following: 3(2) The members shall be appointed by the Lieutenant- Governor in Council to hold office at pleasure as follows: (

a) the term of office of the members representing the producers and forest industries shall be for a period of up to three years each; (

b) the term of office of the other members shall be for a period of up to five years each. (

i) par l’abrogation de l’alinéa d); (ii) à l’alinéa e), par la suppression de « un membre » et son remplacement par «d e u x membres »;

b) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 3(2) Le lieutenant-gouverneur en conseil nomme les membres à

titre amovible qui exercent leurs fonctions comme suit :

a) un mandat d’au plus trois ans pour chacun des membres représentant les producteurs et les industries forestières;

b) un mandat d’au plus cinq ans pour chacun des autres membres.

c) par l’abrogation du paragraphe (3).

section 6 the fol- lowing: 6.1 Any member may participate in a meeting of the Commission by means of telephone or other communica- tion facilities that permit all persons participating in the meeting to hear each other, and any member participating in a meeting by those means shall be deemed to be present at that meeting. 3

Section 8 of the Act is repealed and the following is substituted: 8 The objects of the Commission are (

a) to encourage and facilitate the achievement of ex- panding markets and equitable prices for both the pro- ducer and consumer of purchased primary forest prod- ucts, and (

b) to encourage and facilitate the optimum utiliza- tion of private woodlot resources. 4 Paragraph 9(

b) of the Act is repealed and the follow- ing is substituted: (

b) encourager et faciliter l’utilisation optimale des ressources de terrains boisés privés. 4 L’alinéa 9b) de la Loi est abrogé et remplacé par ce qui suit :

Section 1 (a)(

i) The existing provision is as follows: 3(1) There is hereby established a Commission to be known as the “New Brunswick Forest Products Commission” consisting of a chair- man and six members who shall be appointed by the Lieutenant- Governor in Council as follows:… (

d) one member representing the Department of Agriculture, Fisheries and Aquaculture; (a)(ii) The existing provision is as follows: 3(1) There is hereby established a Commission to be known as the “New Brunswick Forest Products Commission” consisting of a chair- man and six members who shall be appointed by the Lieutenant- Governor in Council as follows: … (

e) one member representing the Department of Natural Re- sources. (

b) The existing provision is as follows: 3(2) The members shall be appointed by the Lieutenant-Governor in Council to hold office at pleasure as follows: (

a) the term of office of the members representing the producers and forest industries shall be for a period of three years each; (

b) the term of office of the other members shall be for five years each. (

c) The existing provision is as follows: 3(3) Notwithstanding subsection (2 ) the first members of the Com- mission shall be appointed so as to allow for the retirement of one member each year as follows: (

a) the Chairman for a term of five years; (

b) the member representing the Department of Natural Re- sources and Energy for a term of four years; (

c) the member representing the Department of Agriculture and Rural Development for a term of three years; (

d) the members representing the producers for a term of two years; (

e) the members representing the forest industries for a term of one year.

Section 2 New provision.

c) La disposition actuelle se lit comme suit : 3(3) Nonobstant le paragraphe (2), les premiers membres de la Com- mission sont nommés de façon à permettre la retraite de l’un des mem- bres chaque année, leur mandat étant alors établi comme suit :

a) le président pour cinq ans;

b) le membre représentant le ministère des Ressources naturelles et de l’Énergie pour quatre ans;

c) le membre représentant le ministère de l’Agriculture et de l’Aménagement rural pour trois ans;

d) les membres représentant les producteurs pour deux ans;

e) les membres représentant les industries forestières pour un an.
