B.C. Reg. 182/2010 , deposited June 25, 2010, pursuant to the HOMEOWNER PROTECTION ACT [Section 32 (2) (

d) and (m)] and the INSURANCE ACT [Section 192 (3) (

c) and (4)]. Order in Council 462/2010, approved and ordered June 24, 2010.

On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

Section 16 (3) of the Building Envelope Renovation Regulation, B.C. Reg. 240/2000, is amended by striking out " Homeowner Protection Office. " and substituting " registrar. ".

2 The Homeowner Protection Regulation, B.C. Reg. 29/99, is amended as set out in the attached Schedule.

3 The Prescribed Persons Regulation, B.C. Reg. 377/98, is repealed.

Schedule

Section 3 of the Homeowner Protection Act Regulation, B.C. Reg. 29/99, is repealed.

Section 4 (5) is amended by striking out " pay the fee " and substituting " pay the reconstruction loan portfolio fee ".

Section 6 (e) (ii) is amended by striking out " registered with the Homeowner Protection Office " .

Section 10 is amended

(

a) in subsection (1) by adding the following paragraph:

(

j) in the case of a designated heritage building that is being converted from commercial to residential use, any component of the designated heritage building that has heritage value and does not conform with the B.C. Building Code. , and

(

b) by adding the following subsection:

(1.1) In subsection (1) (j), "designated heritage building" means a building that is

(

a) a Provincial heritage site within the meaning of the Heritage Conservation Act or included in the Provincial heritage register under that Act, or

(

b) protected through heritage designation or included in a heritage register under the Local Government Act , the Vancouver Charter or the Islands Trust Act .

Section 13 (3) is amended by striking out " Homeowner Protection Office. " and substituting " registrar. ".

Section 4 of

Schedule 1 is amended by striking out " pay a fee " and substituting " pay a reconstruction loan portfolio fee ".
