Section 261 of the Motor Vehicle Act,

chapter M-17 of the Revised Statues, 1973, is amended 1 L’article 261 de la

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 261(1) A local authority may, in its discretion, with re- spect to a highway under its jurisdiction and that it main- tains and the Minister of Transportation may, in his or her discretion, with respect to a provincial highway, issue, upon application, a special permit in writing authorizing the applicant to operate or move a vehicle or combination of vehicles on the highway 261(1) Les autorités législatives locales, s’agissant des routes relevant de leur compétence et dont elles assurent l’entretien, et le ministre des Transports, s’agissant des routes provinciales, peuvent, à leur appréciation et sur de- mande, délivrer une autorisation écrite spéciale permettant au requérant de conduire ou de déplacer sur la route un véhicule ou un train de véhicules : (

a) of any size, with or without load, exceeding the maximum specified in this Act or the regulations,

b) of a gross mass or a mass per axle or combination of axles exceeding the maximum specified in this Act or the regulations,

b) dont la masse brute ou la masse par essieu ou par train d’essieux dépasse le maximum fixé dans la pré- sente loi ou son règlement d’application; (

c) that is not a type of vehicle or a configuration for a type of vehicle specifically prescribed by regulation, or

c) dont le type ou la configuration n’est pas régle- mentaire; (

d) that is otherwise not in conformity with this Act.

Section 1

Article 1 (

a) The existing provision is as follows:

a) Texte de la disposition actuelle 261(1) The Minister of Transportation with respect to provincial highways and local authorities with respect to highways under their jurisdiction may in their discretion, upon application and good cause being shown therefor, issue a special permit in writing authorizing the applicant to operate or move a vehicle or combination of vehicles of a size, with or without load, a gross mass or a mass per axle or combi- nation of axles exceeding the maximum specified in this Act or the regulations or otherwise not in conformity with this Act upon any high- way under the jurisdiction of the party granting such permit and for the maintenance of which such party is responsible. 261(1) Le ministre des Transports, en ce qui concerne les routes provinciales, et les autorités législatives locales, en ce qui concerne les routes relevant de leur juridiction, peuvent, à leur discrétion, sur de- mande appuyée par des motifs valables, délivrer une autorisation écrite spéciale permettant au requérant de conduire ou déplacer un véhicule ou train de véhicules dont la taille, avec ou sans charge, la masse brute ou la masse par essieu ou par train d’essieux dépasse le maximum spé- cifié dans la présente loi ou les règlements ou ne répond pas, pour une autre raison, aux exigences de la présente loi, sur toute route relevant de la juridiction de l’autorité législative qui accorde la permission et qui est responsable de l’entretien de la route. b) Texte de la disposition actuelle 261(2) The application for any such permit shall specifically de- scribe the vehicle or vehicles and load to be operated or moved and the particular highways for which the permit to operate is requested, and whether the permit is requested for a single trip or for continuous op- eration. 261(2) La demande d’une telle autorisation doit contenir une dési- gnation précise du ou des véhicules et du chargement à conduire ou déplacer et des routes pour lesquelles l’autorisation de conduire est de- mandée et indiquer si cette autorisation est demandée pour un seul voyage ou pour un service continu.
