Explanatory Note 2. The present

section 5 rewritten to apply to all virulent or malignant diseases and not just "foul brood". Because of this change, the destruction by fire is made discretionary and not mandatory, as at present.

Section 5 presently reads: "5. 1,Yhen an inspector finds that foul brood of a virulent or malig nant t~·pf:' exists in 1l ny colony of bees, he shall immediately order tho destruction by fire of "(

a) the colony and the hive occupied by it, "(

b) the contents of the hive, and "(

c) all appurtenances of the hive that cannot be disinfected, and may direct that the destruction is to take place there and then, under his personal direction.". 3. New.

Section 6 presently reads: "6.

(1) Any inspector, when he suspects t1#e existence of any infec tious or contagious disease in any colony of bees or in any equipment or product of the bees may by order in writing direct that the bees, equipment or product be held in quarantine until further order. "

(2) In lieu of quarantine or in addition thereto, the inspector may by order in "\vriting direct that the bees, eqUipment or product be treated in the manner directed in the order.". 4. Alternative procedures provided for the delivery of any order oX: an inspector gIVen under the Act.

BILL No. 66 of 1958

An Act to amend The Bee Diseases Act (Assented to , 19/58) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows: 1. The Bee Diseases Act, being

chapter 20 of The Revised Statutes of Alberta, 1955, is hereby anlended.

Section 5 is struck out and the following is substituted: "5. Where an inspector finds that a disease of a virulent or malignant type exists in any colony of bees he may order the destruction by fire of "(

a) the colony and the hive occupied by it, " (

b) the contents of the hive, and "(

c) all appurtenances I of the hive that cannot be sterilized, and may direct that the destruction take place there and then, under his personal direction.".

Section 6 is struck out and the following is substituted: "6.

(1) The Minister may prescribe such procedures as he deems advisable for the control of bee diseases. "

(2) An order of an inspector for the control of any bee disease shall direct that the procedure prescribed by the Minister shall be followed in controlling the disease.". 4. The following new

section is added: "13. Any order given by an inspector pursuant to any of the provisions of this Act shall be deemed to have been duly given and served upon the person to whom the same is addressed, H (

a) upon the order being personally delivered to the person to whom it is addressed, H (

b) by leaving it with any person apparently over the age of sixteen years at the place of abode of the person to whom the notice is addressed, " (

c) by sending it by registered mail in a prepaid cover addressed to the last known postal address of the person to whom the notice is addressed, or

d) where the inspector has reason to believe that the the person to w hom any order is addressed is evading service thereof or that for any reason it is improbable that the order will be received by the person to whom it is addressed within three days of the date of order, if it is delivered in any of the ways hereinbefore mentioned, by posting the order in a conspicuous place on the land referred to in the order or upon any buildings or erections there- on.". 5. This Act comes into force on the day upon which it is assented to.
