Order in Council 134/2016, approved and ordered March 1, 2016.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective September 1, 2016, the regulations set out in the attached

Schedule are amended as set out in that Schedule.

Schedule

Adoption Regulation

Section 20 (

a) of the Adoption Regulation, B.C. Reg. 291/96, is amended by striking out “ an affidavit ” and substituting “ a signed statement ”.

Bare Land Strata Plan Cancellation Regulation

Section 2 (3) (

d) of the Bare Land Strata Plan Cancellation Regulation, B.C. Reg. 556/82, is amended by striking out “ an affidavit ” and substituting “ a signed statement ”.

Manufactured Home Park Tenancy Regulation

Section 39 (7) of the Manufactured Home Park Tenancy Regulation, B.C. Reg. 481/2003, is amended by striking out “ an affidavit ” and substituting “ a signed statement ”.

4 The Appendix is repealed.

Mineral Tenure Act Regulation

Section 18 (1) (b) (iii) of the Mineral Tenure Act Regulation, B.C. Reg. 529/2004, is amended by striking out “ statutory declaration ” and substituting “ signed statement ”.

Off-Road Vehicle Regulation

Section 7 (1) (

c) of the Off-Road Vehicle Regulation, B.C. Reg. 193/2015, is amended by adding “ , in a form satisfactory to the minister, ” after “ signed statement ”.

Permit Regulation

Section 18 of the Permit Regulation, B.C. Reg. 253/2000, is amended

(

a) in subsection (1) by striking out “ statutory declaration or swears an affidavit stating ” and substituting “ signed statement in the form specified by the director confirming ”, and

(

b) in subsection (2) by striking out “ statutory declaration ” and substituting “ signed statement ”.

Schedule 3 is amended in column 2 of the table opposite 18 (2) in column 1 by striking out “ statutory declaration ” and substituting “ signed statement ”.

Pound Districts Regulation

Section 2 (3) (

c) of the Pound Districts Regulation, B.C. Reg. 66/81, is amended by striking out “ statutory declaration stating ” and substituting “ signed statement confirming ”.

Section 18 is amended

(

a) by renumbering the

section as

section 18 (1), and

(

b) by adding the following subsection:

(2) A person who does any of the following commits an offence:

(

a) knowingly provides information that is false or misleading with respect to a material fact contained in a signed statement under

section 2 (3) (c);

(

b) produces or relies upon a signed statement given by another person under

section 2 (3) (

c) while knowing the signed statement to be false or misleading with respect to a material fact contained in the signed statement.

Provider Regulation

Section 6 of the Provider Regulation, B.C. Reg. 222/2014, is amended

(

a) in subsection (1) (

b) and (

c) by striking out “ declaration stating ” and substituting “ signed statement confirming ”, and

(

b) in subsection (2) by striking out “ Declarations ” and substituting “ Signed statements ”.

Renewable and Low Carbon Fuel Requirements Regulation

Section 7.2 (1) (b) (ii) of the Renewable and Low Carbon Fuel Requirements Regulation, B.C. Reg. 394/2008, is repealed and the following substituted:

(ii) includes a signed statement of the officer or employee submitting the report on behalf of the

Part 2 fuel supplier, which signed statement

(

A) confirms that the records evidencing the volume of

Part 2 fuel supplied in the compliance period are available on request, and

(

B) contains the signed statement described in

section 9 (5).

Section 9 (5) is repealed and the following substituted:

(5) A

Part 2 compliance report must be signed by the officer or employee referred to in subsection (3) (

c) and include a signed statement of that officer or employee

(

a) confirming, as applicable, all the following:

(

i) that records evidencing the renewable nature of all renewable fuel supplied in the compliance period are available on request;

(ii) that records evidencing each matter reported under subsection (4) (

b) to (

g) are available on request;

(iii) if the report is submitted by an employee, that a record evidencing the employee’s authority to submit the report on behalf of the

Part 2 fuel supplier is available on request, and

(

b) containing the following statement:

I certify that the information in this report is true and complete to the best of my knowledge and I understand that I may be required to provide to the director records evidencing the truth of that information.

Section 11.022 (1) (b) (ii) is repealed and the following substituted:

(ii) includes a signed statement of the officer or employee submitting the report on behalf of the

Part 3 fuel supplier, which signed statement

(

A) confirms that the records evidencing the volume of

Part 2 fuel supplied in the compliance period are available on request, and

(

B) contains the signed statement described in

section 11.08 (7).

Section 11.08 (7) is repealed and the following substituted:

(7) A

Part 3 compliance report must be signed by the officer or employee referred to in subsection (3) (

c) and include a signed statement of that officer or employee

(

a) confirming, as applicable, all the following:

(

i) that records evidencing the carbon intensity of all

Part 3 fuel reported under subsection (4) (

b) are available on request;

(ii) that records evidencing each matter reported under subsection (4) (

b) to (

f) are available on request;

(iii) if the report is submitted by an employee, that a record evidencing the employee’s authority to submit the report on behalf of the

Part 3 fuel supplier is available on request, and

(

b) containing the following statement:

I certify that the information in this report is true and complete to the best of my knowledge and I understand that I may be required to provide to the director records evidencing the truth of that information.
