An Act to Amend the Coroners Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 The Coroners Act,

chapter C-23 of the Revised Statutes, 1973, is amended by adding after

section the following: 7.1(1) Where an individual dies as a direct result of an accident or other incident which occurred in the course of his or her employment or occupation, the employer and the physician who signs the de- ceased’s death certificate shall, severally, immedi- ately notify a coroner. 7.1(2) Upon receiving notification under subsec- tion (1) the coroner shall hold an inquest. 7.1(3) Where the coroner becomes aware of a death which was, in the coroner’s opinion, likely a direct result of an accident or other incident which occurred in the course of the deceased’s employ- ment or occupation, but the coroner has not received notice from the employer or attending physician, the coroner shall investigate the death to determine whether it falls within the scope of subsection (1), and PROJET DE LOI Loi modifiant la

chapitre C-23 des Lois révisées de 1973, est modifiée par l’adjonction, après l’article 7, de ce qui suit : 7.1(1) Lorsqu’une personne décède en raison d’un accident ou d’un autre incident qui est survenu lors de son emploi ou de son occupation, l’employeur et le médecin qui signe le certificat de décès devront, et de façon indépendante, en aviser le coroner im- médiatement. 7.1(2) Lorsqu’il reçoit un avis en vertu du para- graphe (1), le coroner doit tenir une enquête judi- ciaire. 7.1(3) Lorsque le coroner apprend qu’une mort est probablement, selon le coroner, survenue en rai- son d’un accident ou d’un autre incident qui est sur- venu de l’emploi ou de l’occupation de la personne décédée mais n’a reçu aucun avis de l’employeur, le coroner doit faire enquête sur le décès afin de déter- miner s’il correspond aux circonstances prévues au paragraphe (1) et Projet de loi Loi modifiant la

a) if the coroner finds that the death occurred as a direct result of an accident or other incident in the course of the deceased’s employment or occupation, the coroner shall hold an inquest; or (

b) if the coroner does not find that the death occurred as a direct result of an accident or other incident in the course of the deceased’s employ- ment or occupation, the coroner shall conduct himself or herself in a manner consistent with this Act.
