NEWFOUNDLAND AND LABRADOR REGULATION 40/23 Public Utilities Regulations under the Public Utilities Act (O.C. 2023-116) (Filed May 29, 2023) Under the authority of

section 120 of the Public Utilities Act, the Lieutenant-Governor in Council makes the following regulations. Dated at St. John’s, May 26, 2023. Krista Quinlan Clerk of the Executive Council REGULATIONS Analysis 1.

Short title 2. Definition 3. Threshold amount 4. Commencement 1. These regulations may be cited as the Public Utilities Regulations. 2. In these regulations, "Act" means the Public Utilities Act.

Public Utilities Regulations 40/23 3. For the purposes of subsection 41(3) of the Act, a public utility shall not proceed with the construction, purchase or lease of improvements or additions to its property without the prior approval of the board where (

a) the cost of the construction or purchase is in excess of $750,000; or (

b) the cost of the lease over the expected life of the lease is in excess of $750,000. 4. These regulations come into force on the date the Electrica l Power Control (Amendment) Act , 1994 and Public Utilities (Amendment) Act comes into force. ©King's Printer Threshold amount Commencement 4 Extraordinary Gazette May 29, 2023
