OIC Text: The Governor in Council, on the report and recommendation of the Minister of Public Works dated May 31, 2023, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act ,
Section 80 of
Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act , and clause 73(fa) of
Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act , is pleased to: (
a) extinguish the right of the public to use that portion of the public highway, identified as Parcel C, containing an area of 5,152 square metres (1.27 acres), more or less, located at or near Shieling Drive, Marion Bridge, Cape Breton Regional Municipality, more particularly described in
Schedule “A” (Parcel
C) and as shown on
Schedule “E” attached to and forming part of the Report and Recommendation; (
b) authorize the conveyance of the parcel of surplus land, Parcel C, to George Earl Morgan and Ann Elizabeth Morgan, both of Marion Bridge, Cape Breton Regional Municipality, for the nominal consideration of $1.00, conditional on the conveyance by George Earl Morgan and Ann Elizabeth Morgan to the Crown of Parcels H, D, B, and F, more particularly described in Schedules “A” (Parcel H), “B”, “C” and “D”, and as shown on
Schedule “E” attached to and forming part of the Report and Recommendation; (
c) authorize the Minister of Public Works to make and execute Deeds of Conveyance in such form as the Minister determines to effect the conveyance of the lands herein described; and (
d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purposes of this Order.
