Municipal Planning Strategy and Land Use By-law Amendment Order for Indigo Shores

Special Planning Area

made under

Section 16 of the

Housing in the Halifax Regional Municipality Act

Schedule “A”:

Schedule I - Indigo Shores Special Planning Area

Whereas the Indigo Shores Special Planning Order , N.S. Reg. 59/2022, was made on March

24, 2022, and designated the Indigo Shores Special Planning Area;

Whereas the Executive Panel on Housing in the Halifax Regional Municipality has

recommended amendments to the municipal planning strategy and land-use by-law applicable

to the Indigo Shores Special Planning Area (respectively the Regional Municipal Planning

Strategy and the Beaver Bank, Hammonds Plains and Upper Sackville Land Use By-law);

And

whereas I am satisfied that the recommended amendments are necessary to advance the

purpose of the Housing in the Halifax Regional Municipality Act ;

Therefore, I order the following:

1. The Regional Municipality Planning Strategy is amended by adding the following policy

in bold immediately after Policy S-25:

S-25A Notwithstanding S-25, the area identified as the Indigo Shores Special

Planning Area in accordance with the Housing for Halifax Regional

Municipality Act and as shown as

Schedule I of the Beaver Bank,

Hammonds Plains and Upper Sackville Land Use By-law, shall be

exempt from the restrictions identified in S-25. Further, the

development of this area shall proceed by way of applied R-1 (Single

Unit Dwelling) Zoning and by way of a development agreement to

allow the development of more than 25 lots per year.

2. The Table of Contents of the Beaver Bank, Hammonds Plains and Upper Sackville Land

Use By-law is amended by adding the following text in bold immediately after

“SCHEDULE H: WIND ENERGY ZONING” and before “SCHEDULE: 1-A, 1-B, 1-C,

1-D AND 1-E Zoning Maps”:

SCHEDULE I:INDIGO SHORES SPECIAL PLANNING AREA

Section 3.6 of the Beaver Bank, Hammonds Plains and Upper Sackville Land Use

By-law is amended by adding the following text in bold immediately after “(

i) Conservation Design Developments in accordance with policies S-14, S-15, S-16 and

S-17 of the Regional Municipal Planning Strategy, as applicable.”:

As provided for in the Regional Municipal Planning Strategy for Halifax Regional

Municipality, the area identified as the Indigo Shores Special Planning Area in

accordance with the Housing in the Halifax Regional Municipality Act and as

shown in

Schedule 1 of the Land Use By-law shall be permitted to develop more

than 25 lots per year by development agreement. ”

4. The Beaver Bank, Hammonds Plains and Upper Sackville Land Use By-law is amended

by adding the

Schedule set out in

Schedule “A” to this Order immediately after

Schedule

H of the By-law.

This Order is effective on and after the date of this order.
