OIC Text: The Governor in Council, on the report and recommendation of the Minister responsible for the Nova Scotia Police Complaints Commissioner dated July 13, 2020 and pursuant to

Section 11 of

Chapter 31 of the Acts of 2004, the Police Act , is pleased to, effective August 1, 2020: (

a) re-appoint Judith McPhee, Q.C. of Halifax Regional Municipality (Bedford) to the position of Nova Scotia Police Complaints Commissioner for a term of four months; (

b) subject to clause (c), order that Judith McPhee, Q.C. be remunerated for her services in the amount of $50.00 per hour up to eighty (80) hours per month and be reimbursed for reasonable expenses incurred in fulfilling her duties as Police Complaints Commissioner provided that such reimbursement does not exceed that normally payable to members of the civil service; (

c) order that Judith McPhee, Q.C. be remunerated for her services at such higher rate of pay and up to such hours per month as may be approved by the Treasury and Policy Board for the position of Police Complaints Commissioner, effective from the date of such approval; and (

d) order that the Province shall defend, negotiate or settle claims or charges made against Judith McPhee, Q.C. and indemnify her from personal liability provided that the Province is satisfied the claim arises out of her activities in relation to her appointment as Nova Scotia Police Complaints Commissioner and is not based on fraud or criminal activity and where the Province so defends her, the Province will be in control of the case.
