WHEREAS Upper Fort Garry played a critical role in the development of the Red River Settlement and the creation of Manitoba as a province;

AND

WHEREAS it is important to preserve and protect parts of the site of Upper Fort Garry in order to promote the historical significance of Upper Fort Garry and ensure that appropriate development occurs on the site;

AND

WHEREAS establishing a provincial park on parts of the site of Upper Fort Garry will protect this important piece of Manitoba's history and promote public awareness and appreciation of it;

Attendu :

qu'Upper Fort Garry a joué un rôle essentiel dans le développement de la colonie de la rivière Rouge et la création de la province du Manitoba;

qu'il est important de préserver et de protéger certaines parties d'Upper Fort Garry afin que l'importance historique de ce lieu soit mise en valeur et que des travaux d'aménagement appropriés y soient réalisés;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

Definitions

1 The following

definitions apply in this Act.

"minister" means the minister appointed by the Lieutenant Governor in Council to administer this Act. (« ministre »)

"park" the means Upper Fort Garry Heritage Provincial Park established by

section 2. (« parc »)

Upper Fort Garry Heritage Provincial Park

2 Upper Fort Garry Heritage Provincial Park is hereby established, consisting of

(

a) all those portions of River Lot 1, Parish of St. John, shown on Plan of Survey No. 20424 filed in the Winnipeg office of the Director of Surveys appointed under The Surveys Act ; and

(

b) any additional lands designated by regulation.

2 Est établi le parc provincial du patrimoine d'Upper Fort Garry, composé des terres suivantes :

Provincial park status

3(1) The park is, for all purposes, deemed to be a provincial park under The Provincial Parks Act .

Parc provincial

3(1) Le parc est assimilé à un parc provincial au sens de la

Loi sur les parcs provinciaux .

Heritage park classification

3(2) For the purpose of subsection 7(2) of The Provincial Parks Act , the park is classified as a heritage park .

Loi sur les parcs provinciaux , le parc est un parc du patrimoine.

Land use categorization

3(3) For the purpose of subsection 7(3) of The Provincial Parks Act , all land in the park is categorized in the heritage land use category.

Regulations

7 The Lieutenant Governor in Council may make regulations

(

a) designating additional lands as part of the park;

(

b) respecting any matter necessary or advisable to carry out the purposes of this Act.

8 NOTE: This

section contained a consequential amendment to The Provincial Parks Act that is now included in that Act.

10 This Act comes into force on a day to be fixed by proclamation.
