OIC Text: The Governor in Council on the report and recommendation of the Minister of Labour and Advanced Education dated April 18, 2011, and pursuant to Sections 3, 5 and 6 of

Chapter 37 of the Acts of 2010, the Labour Board Act, is pleased to: (

a) appoint Douglas G. Ruck, Q.C., of Ottawa, Ontario, as the full-time Chair and a member of the Labour Board for a term of office of five (5) years commencing June 13, 2011; (

b) fix the remuneration to be paid to Douglas G. Ruck, Q.C., as the full-time Chair of the Labour Board to be equivalent to the Senior Officials Pay Plan, Deputy Ministers (92) and, commencing April 1, 2012, direct that the Chair shall be entitled to a maximum annual upward adjustment to his compa-ratio of 2% per year to a maximum of Deputy Ministers (110), in any year in which Deputy Ministers receive merit pay adjustments, together with such actual and reasonable expenses as may be incurred by him in the discharge of his duties; (

c) order that the Province shall defend, negotiate or settle claims or charges made against Douglas G. Ruck, Q.C., as a full-time member of the Labour Board, and indemnify him from personal liability in connection with any such claim, provided the Province is satisfied that the claim arises out of his activities in relation to his appointment and is not based on fraud or criminal activity, and where the Province so defends him, the Province will be in control of the case; (

d) re-appoint Peter E. Darby of Halifax, Halifax Regional Municipality, as a Vice-chair of the Labour Board for a term of office of one year commencing May 31, 2011 and designate him as the alternative Chair of the Labour Board in the absence of the Chair for a term of office of one year commencing May 31, 2011; and (

e) fix the remuneration of Peter E. Darby in the following aggregate amounts for his services as a Vice-chair and the alternative Chair of the Labour Board: (i)\x09an annual $15,000 honorarium; (ii)\x09$300.00 per day for each day he conducts a hearing as Vice-chair or alternative Chair or participates in necessary training; (iii)\x09$150.00 per day for each day he necessarily attends the business as Vice-chair or alternative Chair except while conducting a hearing or participating in necessary training; and (iv)\x09such actual and reasonable expenses as may be incurred by him in the discharge of his duties.
