i EXPLANATORY NOTE The Bill establishes two new bodies: the Greater Toronto Services Board (the “Board”) established under

section 2 and the Greater Toronto Transit Authority (“GT Transit”) established under

section 39. The objects of the Board are to promote and facilitate co-ordinated decision making among the municipalities in the Greater Toronto Area and to exercise general direction and control over GT Transit (see

section 3). GT Transit’s primary object is to operate the regional transit system serving the Greater Toronto Area and The Regional Municipal- ity of Hamilton-Wentworth (see

section 40). The Board The Board will be composed of a chair and members representing municipalities in the GTA. For each regional municipality in the GTA, the chair of the regional council will be a member as will the mayor of each lower-tier municipality. The members will also include the mayor of the City of Toronto, ten members of the council of the City of Toronto and one member of the council of the City of Mississauga. (See

section 4). The Board will also include the chair of the council of The Regional Municipality of Hamilton-Wentworth who will vote only on certain matters relating to GT Transit and in elections of the chair of the Board (see

section 5). The number of votes each member has varies and is set out in the Table to the Act (see subsection 15 (1)). The representatives of the City of Toronto have four additional votes on matters relating to GT Transit and in elections of the chair of the Board (see subsection 15 (2)). After each census the Board is required to review its size, composition and the number of votes each member has. (See

section 6). The Board is required to make changes necessary to ensure that the representation principles set out in subsection 6 (3) are followed. The Board is also required to conduct a review before the end of the year 2000 and give a report of that review to the Minister after January 1, 2001. The Board may request the Minister to implement any of the recommendations arising from the review. (See

section 33.)

Section 22 allows the Board to adopt strategies in respect of infrastruc- ture and a countryside strategy (see subsection 22 (1)). Special consul- tation measures are required and a by-law adopting a strategy requires a special majority (see subsections 22 (2) and (3)). The Board may also facilitate the resolution of certain matters of intermunicipal concern within the GTA (see

section 23) and perform other functions relating to its object to promote co-ordinated decision-making among municipal- ities in the GTA (see

section 24). The powers relating to the Board’s other object, the supervision of GT Transit, are set out primarily in sections 61 to 66. GT Transit GT Transit will be composed of a chair and a member of the Board representing each regional municipality in the Greater Toronto Area or one of its lower-tier municipalities and a member representing the City of Toronto (see clauses 41 (1) (

a) and (b)). The chair of The Regional Municipality of Hamilton-Wentworth will also be a member (see clause 41 (1) (c)). Most of GT Transit’s powers are set out in sections 53 and 54. Financial arrangements The Board has the power, under

section 28, to raise money for its costs by levying amounts against the City of Toronto and the regional municipalities in the Greater Toronto Area. These amounts are appor- tioned among the municipalities according to their weighted assess- ments.

With respect to the Board’s costs relating to GT Transit, the Board shall levy amounts under sections 64 and 65 against the participating municipalities (the City of Toronto, the regional municipalities in the Greater Toronto Area and The Regional Municipality of Hamilton- NOTE EXPLICATIVE Le projet de loi crée deux nouvelles entités : la Commission des services du grand Toronto (la «Commission»), créée en vertu de l’article 2, et la Régie des transports en commun du grand Toronto (le «Réseau GT»), créée en vertu de l’article 39.

ii Wentworth).

Section 64 relates to the net costs of GT Transit.

Section 65 relates to costs of borrowing the Board undertakes for GT Transit purposes. The Board can also require the participating municipalities to pay GT Transit amounts for its capital requirements (see clause 61 (1) (

d) and

section 66). The Board shall require GT Transit to pay amounts out of any surplus it might have to offset the costs of borrow- ing by the Board or to reimburse participating municipalities for pay- ments for GT Transit’s capital requirements (see subsections 65 (4) and 66 (6)). The Board will determine how amounts levied by the Board relating to GT Transit are apportioned (see clause 61 (1) (

b) and subsections 64 (3) and 65 (3)). Where the Board directs participating municipalities to pay amounts for GT Transit’s capital requirements, the by-law will set out which municipalities are directed to pay and how much and when each must pay (see subsection 66 (3)). Amendments to the Toronto Area Transit Operating Authority Act and transfers to GT Transit

Section 70 of the Bill amends the Toronto Area Transit Operating Authority Act . The Toronto Area Transit Operating Authority (the “Authority”) is continued but its composition and objects are changed significantly. It will be composed of a number of deputy ministers or assistant deputy ministers (see the subsection 2 (2) of the Act set out in subsection 70 (2) of the Bill). The Authority’s primary object will be to exercise its rights and fulfil its obligations with respect to its railway rolling stock that is subject to certain conditional sale agreements (see

section 5 of the Act set out in subsection 70 (4) of the Bill). The commuter services operated by the Authority, are transferred to GT Transit (see subsection 71 (1) of the Bill). The Authority’s assets and liabilities are transferred to GT Transit with some exceptions (see sub- sections 71 (2) and (3)). The Authority retains the railway rolling stock to which its primary object relates as well as the rights and liabilities under the conditional sale agreements that relate to that rolling stock (see subsections 71 (4) and (5)).

The employees of the Authority are not transferred to GT Transit although certain provisions are made with respect to non-bargaining unit employees who accept employment with GT Transit (see subsections 71 (6) to (9)).
