Definitions

1 The following

definitions apply in this regulation.

"Act" means The Public Health Act , C.C.S.M. c. P210, and includes the regulations made under that Act. (« Loi »)

"government agency" , "government department" , "information" and "person" have the same meanings as under

section 77 of the Act. (« ministère », « organisme gouvernemental », « personne » et « renseignements »)

"health officer (food)" means a health officer described in

section 10 of the Public Health Personnel Regulation . (« agent hygiéniste spécialisé en alimentation »)

"Indian band" means a band as defined in the Indian Act (Canada). (« bande indienne »)

Information sharing: director, medical officer, inspector, public health nurse

2(1) For the purpose of administering or determining compliance with the Act, or a municipal by-law pursuant to an agreement under subsection 21(1) of the Act, a director, medical officer, public health inspector or public health nurse may disclose information to any of the following persons:

(

a) the chief public health officer;

(

b) a director, medical officer, public health inspector, public health nurse or health officer;

(

c) a health professional;

(

d) a health care body as defined under The Freedom of Information and Protection of Privacy Act ;

(

e) a person who carries out responsibilities or functions similar to those carried out by any of the persons described in clause (

b) for or on behalf of

(

i) an Indian band,

(iii) the government of a province or territory of Canada, or an agency of such a government,

(iv) the government of a country or state outside Canada, or an agency of such a government;

(

f) a government department or government agency;

(

g) a local government body as defined under The Freedom of Information and Protection of Privacy Act .

Échange de renseignements — directeur, médecin hygiéniste, inspecteur ou infirmière d'hygiène publique

2(1) Afin d'appliquer la Loi ou, conformément à un accord conclu en vertu de son paragraphe 21(1), un règlement municipal ou de contrôler l'application de ces textes , un directeur, un médecin hygiéniste, un inspecteur ou une infirmière d'hygiène publique peut communiquer des renseignements :

a) au médecin hygiéniste en chef;

b) à un directeur, à un médecin hygiéniste, à un inspecteur, à une infirmière d'hygiène publique ou à un agent hygiéniste;

c) à un professionnel de la santé;

d) à un organisme de soins de santé au sens de la

Loi sur l'accès à l'information et la protection de la vie privée ;

e) à toute personne qui exerce des fonctions comparables à celles exercées par des personnes visées à l'alinéa b) au nom :

(

i) d'une bande indienne,

(iii) du gouvernement d'une province ou d'un territoire du Canada ou d'un de ses organismes,

(iv) du gouvernement d'un pays ou d'un État étranger ou d'un de ses organismes;

f) à un ministère ou à un organisme gouvernemental;

g) à un organisme d'administration locale au sens de la

Loi sur l'accès à l'information et la protection de la vie privée .

2(2) A director, medical officer, public health inspector or public health nurse may also disclose information to any of the following persons:

(

a) an educational body as defined under The Freedom of Information and Protection of Privacy Act , or the operator of an independent school as defined under The Education Administration Act , if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to the health of students or staff of the educational body or independent school, or to the health of any other person;

(

b) an employer, if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to the health of the employer's staff or patrons, or to the health of any other person;

(

c) the operator of a daycare, if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to the health of children cared for in the daycare, their parents or guardians, staff of the daycare, or to the health of any other person;

(

d) any other person, if the director, medical officer, public health inspector or public health nurse is of the opinion that the disclosure is necessary to prevent, lessen or deal with a threat to public health.

2(2) Lorsqu'il est d'avis que la communication est nécessaire aux fins mentionnées ci-dessous, le directeur, le médecin hygiéniste, l'inspecteur ou l'infirmière d'hygiène publique peut également communiquer des renseignements :

a) à un organisme d'éducation au sens de la

Loi sur l'accès à l'information et la protection de la vie privée ou à l'exploitant d'une école indépendante au sens de la

Loi sur l'administration scolaire afin de prévenir ou d'atténuer une menace pour la santé des étudiants ou du personnel de l'organisme d'éducation ou de l'école indépendante ou celle de toute autre personne ou afin d'y faire face;

b) à un employeur afin de prévenir ou d'atténuer une menace pour la santé de son personnel ou de ses clients ou celle de toute autre personne ou afin d'y faire face;

c) à l'exploitant d'une garderie afin de prévenir ou d'atténuer une menace pour la santé des enfants qui fréquentent la garderie ou celle de leurs parents, de leurs tuteurs, du personnel de la garderie ou de toute autre personne ou afin d'y faire face;

d) à toute autre personne afin de prévenir ou d'atténuer une menace pour la santé publique ou afin d'y faire face.

Information sharing: health officer (food)

3(1) For the purpose of administering or determining compliance with the Act, or a municipal by-law pursuant to an agreement under subsection 21(1) of the Act, in relation to food, food handling establishments or the transportation of food

(

a) a health officer (food) has the same authority to disclose information that a public health inspector has under subsection 2(1); and

(

b) all references to "public health inspector" in subsection 2(1) are deemed to include a health officer (food).

3(1) Afin d'appliquer la Loi ou, conformément à un accord conclu en vertu de son paragraphe 21(1), un règlement municipal ou de contrôler l'application de ces textes relativement aux aliments, à leur transport ou aux établissements chargés de leur manutention, l'agent hygiéniste spécialisé en alimentation a, en matière de communication de renseignements, le pouvoir qu'un inspecteur a en vertu du paragraphe 2(1). Toute mention de « inspecteur » à ce paragraphe est réputée viser un agent hygiéniste spécialisé en alimentation.

3(2) If a health officer (food) is of the opinion that disclosure of information is necessary to prevent, lessen or deal with a threat to public health that relates to food, a food handling establishment or the transportation of food,

(

a) the health officer (food) has the same authority to disclose information that a public health inspector has under subsection 2(2); and

(

b) all references to "public health inspector" in subsection 2(2) are deemed to include a health officer (food).

Limit on information disclosed

4 Information disclosed under this regulation must be limited to the minimum amount necessary to accomplish the purpose for which it is disclosed.

Coming into force

5 This regulation comes into force on the same day that The Public Health Act , S.M. 2006, c. 14, comes into force.
