EXPLANATORY NOTE NOTE EXPLICATIVE The Engineering and Geoscientific Professions Act provides for the regulation of those professions and related disciplines by the Association of Professional Engineers and Geoscientists of the Province of Manitoba. This Bill amends the Act as follows.

OF REGISTRAR The registrar is now made responsible for • registering engineers and geoscientists from other jurisdictions as members of the association; and • authorizing engineers and geoscientists to practise their professions through a partnership, corporation or other legal entity.

SPECIFIED SCOPE OF PRACTICE LICENSEES An individual who does not meet the requirements for membership in the association, but is qualified to practise within a limited scope of engineering or geoscience may conduct their practice in a manner more similar to a member, including through a partnership, corporation or other legal entity.

CONTINUING PROFESSIONAL DEVELOPMENT The association may now publish the name of a person whose registration is suspended because the person did not meet continuing professional development obligations.

The association may also make by-laws clarifying the obligations of engineers and geoscientists with respect to continuing professional development.

APPEALS A person whose registration or licence is suspended for non-payment of dues may no longer appeal the suspension. An appeal committee is established to hear appeals of decisions of the association related to registering persons to practise engineering or geoscience.

Decisions of the discipline committee of the association relating to skill in practice and professional conduct may now be appealed directly to the Court of Appeal by the engineer or geoscientist or the association. Consequential amendments are made to The Groundwater and Water Well Act, The Land Surveyors Act, The Provincial Railways Act and The City of Winnipeg Charter.
