Its purpose is to effect a reallocation of responsibilities as between the Province and municipalities by transferring to munici- palities responsibility for the funding and delivery of certain services previously provided by the Province. The Bill amends a number of Acts and enacts one new Act. The amendments and the new Act are set out in separate schedules by subject matter. The matters being dealt with in each

schedule are described below.

SCHEDULE A AMENDMENTS TO THE AMBULANCE ACT AND THE HEALTH FACILITIES SPECIAL ORDERS ACT The

Schedule amends the Ambulance Act in order to transfer responsibility for the funding and provision of land ambulance ser- vices to upper-tier municipalities and, in areas where there are no upper-tier municipalities, to delivery agents designated by the Min- ister. The

Schedule amends the Ambulance Act by dividing it into the following Parts:

Part I -

Definitions Several new

definitions (such as “air ambulance services” and “land ambulance services”) have been added. The definition of municipality has been replaced with two separate

definitions, one for local municipalities and one for upper-tier municipalities. An upper- tier municipality includes a county, the City of Toronto, the county of Prince Edward and the Municipality of Chatham-Kent.

Part II - Provincial Responsibilities The duties of the Minister are set out in

section of the Act. They include ensuring the operation and maintenance of communica- tion services used in dispatching ambulances throughout the Prov- ince, funding and ensuring the provision of air ambulance services and licensing and setting standards for operators of land ambulance services. The Minister has the power to make grants to municipalities and to operators.

Part III - Responsibilities of Upper-Tier Municipalities

Section of the Act transfers responsibility for funding, and for ensuring the provision of, land ambulance services to upper-tier municipalities. In discharging its responsibilities, a municipality may operate an ambulance service itself or select another person to do so. It must ensure that operators of ambulance services are supplied with ambulances, equipment and such other things as may be necessary to properly provide land ambulance services.

The responsibility for funding land ambulance services is trans- ferred to upper-tier municipalities as of January 1, 1998 and the responsibility for ensuring the provision of land ambulance services is transferred as of January 1, 2000. During the two years between January 1, 1998 and January 1, 2000, the Province will pay for the services provided by existing operators and bill each municipality for its share of what the Province pays.

An upper-tier municipality may, with the approval of the Min- ister, assume responsibility for the provision of land ambulance ser- vices in the municipality before January 1, 2000. If a municipality does so, the Province will not pay for the land ambulance services and bill the municipality; rather, the municipality will pay for the land ambulance services directly.

An existing operator is entitled to be licensed to continue operating its ambulance service until December 31, 1999.

Each upper-tier municipality must, on or before September 30, 1999, select one or more persons to provide land ambulance services in the municipality on and after January 1, 2000.

Part IV - Delivery Agents

Section 6.7 of the Act gives the Minister powers to designate areas that are not included in upper-tier municipalities and to desig- nate a delivery agent for each designated area. The delivery agent has all the powers and responsibilities of an upper-tier municipality with respect to the funding and provision of land ambulance services in the designated area. The costs of the delivery agent are to be paid by the local municipalities included in the designated area in accordance with the regulations.

If a designated area includes territory without municipal organization, the inhabitants of that area must pay their portion of the costs of the delivery agent in accordance with the regulations, unless they are exempted by regulation. If the Minister does not designate a delivery agent for an area of the Province that is not included in an upper-tier municipality, the Ministry is deemed to be the delivery agent for that area.

Part V - Licences This Part provides for the issuing, suspension, revocation and refusal to renew a licence. Minor amendments are made to this Part.

Part VI - General The amendments to the provisions in this Part of the Act include the following: 1. Amendments to provide for the service of notice on municipalities and delivery agents. 2. Amendments to the inspection provisions to give inspec- tors and investigators the power to require information from operators or from the employees of an operator at any time, whether during an inspection of premises or at any other time. 3. An amendment adding a provision that prohibits the charging of fees or co-payments for ambulance services unless it is authorized under the Ambulance Act or the Health Insurance Act. 4.

Amendments to the regulation-making powers including the power (section 22.1) to provide for the sharing and reallocation of the cost of providing land ambulance ser- vices in two or more upper-tier municipalities or desig- nated areas. 5. Amendments to increase the fines imposed for offences under the Act. The

Schedule also amends the Health Facilities Special Orders Act to ensure that, in the circumstances described in that Act, the Minister may require that a person selected by the Minister be issued a temporary licence to operate an ambulance service. The costs incurred by the Ministry in taking control of an ambulance service are paid by the upper-tier municipality, or by the delivery agent, who is responsible for paying for the service under the Ambulance Act.
