EXPLANATORY NOTE NOTE EXPLICATIVE This Explanatory Note was written as a reader’s aid to Bill 4 and does not form part of the law. Bill 4 has been enacted as

Chapter 8 of the Statutes of Ontario, 2003.

Sections 79.3 to 79.10 of the Ontario Energy Board Act, 1998 contain provisions relating to electricity pricing that, under sec - tion 79.11, may be repealed b y proclamation of the Lieuten ant Governor on or after May 1 , 2 006. The Bill amends

section 79.11 to provid e that those prov isions will be re pealed on Ma y 1, 2006, unless they are repealed earlier b y proclamation of th e Lieutenant Governor.

Section 79.4 of the Act de als with the com modity price for el ectricity p ayable b y low-volume cons umers an d designated consumers. The existing

section provides for a price of 4.3 cents per kilowatt hour or such lower price as the Lieutenant Governor in Council may prescribe by regulation. The Bill amends

section 79.4 to provide that, with respect to electricity used before May 1 , 2005 o r such earlier date as is prescribed by the r egulations, the price will be de termined b y a r egulation m ade b y the Lieutenant Gov ernor in Council. With respect to elec- tricity used on o r after May 1, 2005, or the earlier date prescribed b y t he regula tions, the pric e will b e deter - mined by the Ontario Energy Board in a ccordance with the regulations. 1.

Section 79.6 of the existing Act requires the approval of the Minister of Energy for an application to the Ontario Energy Board to approve or fix new rates for transmit- ting electricity, distributing el ectricity or re tailing e lec- tricity to meet a distributo r’s default supply obligations under

section 2 9 of the Electricity Act, 1998 . The Bi ll amends

section 79.6 so that th e approval requirement no longer applies to rates for transm itting electricity. Cor- responding changes are made to sections 79.7, 7 9.8 and 79.9, which deal with th e Boar d’s power to review its rate orders, the Minister’s power to require amendments to rate orders and the Minister ’s power to require re- views of rate orders. 2.

Other amendments made by the Bill include the following: Le projet de loi apporte d’autres modifications, notamment :

Section 78 of th e Act is amended to requir e the Ontario Energy Board to approve or fix separate electricity rates for different situations prescribed by regulation. Those situations would be defined with reference to amounts of electricity used and tim es wh en elec tricity is used. In addition, with respect to rates for the retailing of electric- ity in order to meet a dist ributor’s default supply obliga- tions under

section 29 of the Electricity Act, 1998, sec- tion 78 is amen ded to requ ire the Board to comply with regulations governing the approving or fixing o f those rates. 1.

Section 88.0.1 of the Act is amended to permit the making of regulations requiring distributors, retail- ers or the Independent Electricity Market Operat or (the IMO) t o m ake paym ents t o ce rtain l ow- volume consu mers and de signated co nsumers, i f the Minister of Finance determines that, in respect of th e period for wh ich th e commodity p rice fo r electricity was determ ined by the Lieutenant Gov- ernor in Council, the a mount received by the On- tario Electricit y Fin ancial Co rporation in co nnec- tion with the Act exceeds the am ount expended by the Corporation in connection with the Act. Regu- 2.
