Loi sur l’indemnisation des pompiers 1(1) Subsection 14(1) of the Firefighters’ Compensa- tion Act,

chapter F-12.5 of the Acts of New Brunswick, 2009, is repealed and the following is substituted: 1(1) Le paragraphe 14(1) de la

Section 18 of the Act is repealed and the follow- ing is substituted: 1(2) L’article 18 de la Loi est abrogé et remplacé par ce qui suit : 18 The Commission may in its discretion diminish the compensation to which a firefighter or former firefighter is entitled or suspend payment of the compensation in any of the following circumstances: 18 La Commission peut, à sa discrétion, réduire l’in- demnité versée à un pompier ou à un ancien pompier ou en suspendre le paiement dans l’une quelconque des cir- constances suivantes : (

a) the firefighter or former firefighter does not at- tend or participate in an examination when required to do so by the Commission or obstructs the examina- tion;

Section 41 of the Act is amended 2(5) L’article 41 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

c) the worker persists in dangerous and unsanitary practices imperilling or impeding the rehabilitation of the worker.

f) par l’abrogation du paragraphe (16). 2(6) Subsection 54(1.1) of the Act is repealed and the following is substituted: 2(6) Le paragraphe 54(1.1) de la Loi est abrogé et remplacé par ce qui suit : 54(1.1) Despite subsection (1), in the event the Com- mission incurs a deficit in any fiscal year, the Commis- sion shall take the necessary steps following the occur- rence of the deficit to assess, levy and collect sufficient funds to fund the deficit within the period of time deter- mined to be reasonable and prudent by the Commission in the circumstances, to a maximum of 15 years. 54(1.1) Par dérogation au paragraphe (1), si elle ac- cuse un déficit au cours d’un exercice financier quel- conque, la Commission prend ensuite les mesures nécessaires afin de fixer une cotisation et de prélever et de percevoir les fonds qui permettront de le combler dans le délai qu’elle estime raisonnable et prudent dans les circonstances, ce délai ne pouvant dépasser quinze ans.

Section 21 of the Workplace Health, Safety and Compensation Commission and Workers’ Compensa- tion Appeals Tribunal Act,

chapter W-14 of the Acts of New Brunswick, 1994, is amended 3 L’article 21 de la

a) by repealing subsection (3) and substituting the following:

a) par l’abrogation du paragraphe (3) et son rem- placement par ce qui suit : 21(3) Despite any other provision of this Act, the Workers’ Compensation Act and the Occupational Health and Safety Act , but subject to subsections 21(9) and (9.1) of this Act, the Appeals Tribunal shall have all of the authority conferred on the Commission under this Act, the Workers’ Compensation Act and the Occupa- tional Health and Safety Act to examine into, hear and determine all matters affecting an employer, a worker or a dependent that arise in any appeal to it under subsec- tion (1). 21(3) Par dérogation à toute autre disposition de la présente loi, de la
