Section of the Employment Standards Act, chap ‐ ter E-7.2 of the Acts of New Brunswick, 1982, is amended L’article de la

Loi sur les normes d’emploi, cha ‐ pitre E-7.2 des Lois du Nouveau-Brunswick de 1982, est modifié (

a) by repealing the definition “employer” and substituting the following:

a) par l’abrogation de la définition d’« em ‐ ployeur » et son remplacement par ce qui suit : “employer” means a person, firm, corporation, agent, manager, representative, contractor or subcontractor that, being responsible for a place of employment, does the following, and includes an employer as defined in the Public Service Labour Relations Act , but does not in ‐ clude a person that, directly or indirectly, has control or direction of or is responsible for the employment of a person in or about the person’s private home: « employeur » s’entend, à l’exception d’une personne qui a, même indirectement, le contrôle, la direction ou la responsabilité de l’emploi de personnes travaillant dans sa maison privée ou autour de celle-ci, d’une personne, d’une firme, d’une personne morale, d’un représentant, d’un directeur, d’un agent, d’un entrepreneur ou d’un sous-traitant, y compris un employeur selon la définition que donne de ce terme la Loi relative aux relations de travail dans les services publics , qui, étant responsable d’un lieu d’emploi, (

a) authorizes a person to be present at the place of employment to perform work, supply services or re ‐ ceive training; and

a) autorise la présence d’une personne dans ce lieu d’emploi aux fins d’exécution de travaux, de fournitu ‐ re de services ou d’obtention d’une formation, et (

b) directly or indirectly, has control or direction of or is responsible for the employment of a person; (em‐ ployeur)

b) par l’abrogation de la définition de « salarié » et son remplacement par ce qui suit : “employee” means a person who performs work for or supplies services to an employer for wages, and in ‐ cludes the following persons but does not include an in ‐ dependent contractor or a person who engages in an ac ‐ tivity exempted by regulation: « salarié » s’entend, à l’exception d’un entrepreneur indépendant ou de quiconque se livre à une activité exemptée par règlement, d’une personne qui exécute des travaux pour un employeur ou lui fournit des services, moyennant salaire, notamment (

a) a person who performs work or supplies services at the place of employment, regardless of whether the person receives accommodations to meet the person’s needs; and

a) celle qui exécute des travaux ou qui fournit des services dans le lieu d’emploi, qu’elle bénéficie ou non de mesures d’accommodement, et (

b) a person who receives training, if the skill in which the person is being trained is a skill used by other employees at the place of employment, regard ‐ less of whether the person receives accommodations to meet the person’s needs; (salarié)

Section of the Act is amended by adding after paragraph (

a) the following: 2 L’article de la Loi est modifié par l’adjonction de ce qui suit après l’alinéa a) : (a.1) for the purposes of the definition “employee” in

section 1, prescribing exempted activities; a.1) aux fins d’application de la définition de « sala‐ rié » figurant à l’article 1, prescrire les activités qui sont exemptées; Commencement Entrée en vigueur This Act comes into force on a day to be fixed by proclamation. 3 La présente loi entre en vigueur à la date fixée par proclamation.
