On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the Court of Appeal Rules, B.C. Reg. 120/2022, are amended as set out in the attached Schedule.

Schedule

1 Rule 6 (1) (

b) of the Court of Appeal Rules, B.C. Reg. 120/2022, is amended by striking out " Rule 4 (2) " and substituting " Rule 4 (1) ".

2 Rule 64 (2) is amended by striking out " subrule (2) " and substituting " subrule (3) ".

3 Rule 92 is repealed and the following substituted:

Bringing cross appeals in relation to pre-existing applications for leave to appeal

92 A respondent who has been served an order granting leave to appeal in relation to a pre-existing application for leave to appeal may bring a cross appeal by complying with Rule 9 and, for that purpose, "a notice of appeal" in Rule 9 must be read as "an order granting leave to appeal in relation to a pre-existing application for leave to appeal".

4 Form 1 in

Schedule 3 is amended

(

a) by adding " Include any order as to costs. " after " For example: "Set aside the trial judgment and order a new trial." ", and

(

b) by striking out " (Form 2 of the Court of Appeal Rules ) " and substituting " (Form 2 of the Court of Appeal Rules) ".

5 Form 3 in

Schedule 3 is amended by striking out " include the law firm’s address. Otherwise " and substituting " include the law firm’s address; otherwise ".

6 Form 8 in

Schedule 3 is amended by striking out " the " before " person(

s) bringing the application ".

7 Form 18 in

Schedule 3 is amended by striking out " person authorizing filing of this form. " and substituting " person authorizing filing of this form ".
