Filing fees

1 The following fees are payable to The Municipal Board on filing an application or appeal, or on commencing a proceeding:

(

a) application by a local authority under any Act for approval of a by-law or for authorization to borrow money, to do any work or to enter into an agreement

$50;

(

b) appeal under subsection 56(2) of The Municipal Assessment Act : a fee of $10 for each $100,000 of the assessed value of the property that is the subject of the appeal, as determined by the board of revision, subject to a minimum fee of $50 and a maximum fee of $500;

(

c) application for cancellation, amendment or alteration of a plan of subdivision under

section 95 of The Municipal Board Act

$200;

(

d) application to vary or discharge a building restriction caveat under

section 104 of The Municipal Board Act

$75;

(

e) appeal from a decision of an approving authority under subsection 129(1) of The Planning Act

$200;

(

f) for any other application, appeal or proceeding commenced before the board

$200.

Droits de dépôt

Hearing fee

2(1) In addition to any fee payable under

section 1, a person or local authority that initiates a proceeding shall pay a hearing fee to the board of $350 for each day, or part of a day, after the first day of a hearing.

Zoning by-law hearing

2(2) For the purpose of this section, a hearing under subsections 77(5) and 78(1) of The Planning Act is deemed to be initiated by the planning district or municipality whose by-law is the subject of the hearing.

Hearing fee a debt

2(3) A hearing fee under subsection (1) is, from the date of an order made by the board, a debt due and payable to the board by the initiator of the proceedings.

Debenture fees

3(1) A local authority shall pay a debenture fee to the board, as follows, subject to a minimum fee of $50 and a maximum fee of $1,000:

(a) $1 for each $1,000 of debentures issued;

(

b) for preparation of debentures,

(

i) where debentures are prepared in board offices, $50, and

(ii) where debentures are not prepared in board offices, $2 for each debenture issued.

3(2) The fees under subsection (1) are, on issuance of debentures, a debt due and payable by the local authority to the board.

Board may vary fee

4 Notwithstanding sections 1 to 3, where the board is of the opinion that the imposition of a fee under those sections would not be fair and just, the board may,

(

a) order that all or part of the fee be refunded;

(

b) order that no fee be payable; or

(

c) vary the amount of the fee payable.

Modification des droits par la Commission
