Definitions Définitions 3 The following

definitions apply in this

section and in sections 4 to 6. 3 Les définitions qui suivent s’appliquent au présent

article et aux articles 4 à 6. “administrator” means (

a) the administrator of a transferring plan, or (

b) the administrator of a receiving plan. (adminis‐ trateur) « administrateur » S’entend de la personne qui ad ‐ ministre :

a) soit un régime cédant;

b) soit un régime cessionnaire. (administrator) 1

“authority” means the person appointed to serve as the Sustainable Pension Plan Authority under subsec ‐ tion 12(1) of the repealed Act. (autorité) “Board” means the Labour and Employment Board established under the Labour and Employment Board Act. (Commission) “Minister” means the Minister of Finance and Treasury Board and includes any person designated by the Minister to act on the Minister’s behalf. (ministre) “parties” means the parties prescribed under

section 4 of the repealed regulation. (parties) “receiving plan” means a receiving plan as defined in the repealed Act. (régime cessionnaire) “repealed Act” means the Pension Plan Sustainabil ‐ ity and Transfer Act,

chapter 42 of the Acts of New Brunswick, 2023. (loi abrogée) “repealed regulation” means New Brunswick Regu ‐ lation 2024-3 under the Pension Plan Sustainability and Transfer Act. (règlement abrogé) “Superintendent” means the Superintendent of Pen ‐ sions appointed under the Financial and Consumer Services Commission Act and includes persons to whom the Superintendent or the Financial and Con ‐ sumer Services Commission has delegated powers and duties under that Act or the Pension Benefits Act. (sur‐ intendant) “transferring plan” means a pension plan prescri ‐ bed under

section 3 of the repealed regulation. (régime cédant) “Tribunal” means the New Brunswick Energy and Utilities Board continued under

section 3 of the Energy and Utilities Board Act. (Tribunal) « autorité » L’autorité en matière de pérennité des régimes de pension désignée en vertu du paragra ‐ phe 12(1) de la loi abrogée. (authority) « Commission » La Commission du travail et de l’emploi constituée par la

Loi sur la Commis ‐ sion des services financiers et des services aux consommateurs et, en outre, des personnes auxquelles lui ou la Commission des services financiers et des ser ‐ vices aux consommateurs a délégué ses attributions en vertu de cette loi ou de la

Loi sur les prestations de pen‐ sion. (Superintendent) « Tribunal » La Commission de l’énergie et des ser ‐ vices publics du Nouveau-Brunswick prorogée à l’arti ‐ cle 3 de la

Loi sur la Commission de l’énergie et des services publics. (Tribunal) Revocation of appointment of the authority Annulation de la désignation de l’autorité 4(1) The appointment of the authority is revoked. 4(1) La désignation de l’autorité est annulée. 4(2) No action or other proceeding lies or shall be in ‐ stituted against the Crown in right of the Province or the Minister as a result of the revocation of the ap ‐ pointment of the authority under subsection (1). 4(2) La Couronne du chef de la province et le minis ‐ tre bénéficient de l’immunité de poursuite engagée par voie d’action ou autre instance par suite de l’annula ‐ tion de la désignation de l’autorité prévue au paragra ‐ phe (1).

Validity of orders and decisions Validité des ordonnances et décisions 5(1) Despite

section 24 of the repealed Act, on and after the commencement of this section, the following orders and decisions are deemed to be in force and ef ‐ fective: 5(1) Par dérogation à l’article 24 de la loi abrogée et à partir de l’entrée en vigueur du présent article, les or‐ donnances et les décisions qui suivent sont réputées avoir effet et force exécutoire : (

a) the order of the Superintendent dated January 30, 2023, in respect of the Pension Plan for General and Service Employees of New Brunswick Nursing Homes, established effective April 1, 1982, and reg ‐ istered with the Superintendent as NB.0447938, as amended;

a) l’ordonnance du surintendant datée du 30 jan‐ vier 2023 portant sur le régime appelé Pension Plan for General and Service Employees of New Brunswick Nursing Homes, entré en vigueur le 1 er avril 1982, enregistré auprès du surintendant et portant le numéro NB.0447938, avec ses modifica‐ tions; (

b) any order made by the Tribunal or the Board in respect of the order of the Superintendent refer ‐ red to in paragraph (a); and

b) toute ordonnance rendue par le Tribunal ou la Commission portant sur l’ordonnance du surinten ‐ dant mentionnée à l’alinéa a); (

c) any decision of an arbitrator or arbitration board appointed or established in accordance with a collective agreement or

an act other than this Act for the purpose of arbitrating a dispute with respect to a transferring plan between an employer participating in the transferring plan and the bargaining agent for the employees participating in that plan.

b) and (

Immunity Immunité de poursuite 6(1) No action or other proceeding lies or shall be in ‐ stituted against any of the following persons for any ‐ thing done or purported to be done in good faith by any of them or for anything omitted in good faith by any of them in the exercise or intended exercise of a power or duty under the repealed Act from December 13, 2023, to the commencement of this subsection, inclusive: 6(1) Bénéficient de l’immunité de poursuite engagée par voie d’action ou autre instance les personnes qui suivent pour tout acte accompli ou paraissant avoir été accompli de bonne foi ou toute omission commise de bonne foi entre le 13 décembre 2023 et l’entrée en vi ‐ gueur du présent paragraphe, inclusivement, dans l’exercice effectif ou censé tel des attributions que leur conférait la loi abrogée : (
