Electric Energy Marketing Act Repeal Act

DEFICIENCY REGULATION

Filed: March 18, 1997

Made by the Lieutenant Governor in Council (O.C. 120/97) pursuant to

section 13 of the Electric Energy Marketing Act Repeal Act.

Definitions

1 In this Regulation,

(a) "Agency" has the meaning given to it in the former Act;

(b) "Board" means the Alberta Energy and Utilities Board;

(c) "former Act" means the Electric Energy Marketing Act, SA 1981

cE-4.1;

(d) "General Regulation" means the General Regulation (Alta. Reg.

405/84) made pursuant to the former Act;

(e) "owners" means Alberta Power Limited, TransAlta Utilities

Corporation and the City of Edmonton.

Adjustment order for 1995

2 Despite

section 17.4(1) of the General Regulation, if an adjustment

order for the year 1995 is made by the Board on or before May 31, 1997, the

Agency and the owners shall in 1997 make any payments among themselves that

may be necessary to give effect to that adjustment order.

Effect of order being made after December 31, 1996

3 Rights arising from or obligations imposed by the former Act, the

General Regulation or the Electric Energy Marketing Act Repeal Act shall

not be adversely affected by the Board's making an adjustment order for the

year 1995 after December 31, 1996 and before June 1, 1997.

Expiry

Expiry

4 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be re-passed

in its present or an amended form following a review, this Regulation

expires on December 31, 1999.

Insurance Act

FEES, FORMS AND CERTIFICATES EXPIRY

AMENDMENT REGULATION

Filed: March 18, 1997

Made by the Lieutenant Governor in Council (O.C. 124/97) pursuant to

section 22 of the Insurance Act.

1 The Fees, Forms and Certificates Expiry Regulation (AR 478/81) is

amended by this Regulation.

2 The following is added after

section 1:

1.1 An insurer that

(

a) is licensed on July 1 of each year shall, subject

to clause (c), pay the Alberta Insurance Council a fee of $600 on July 1 of

that year;

(

b) becomes licensed after July 1 of that year but

before July 1 of the following year shall pay a fee of $600 to the Alberta

Insurance Council on the date that it becomes licensed;

(

c) becomes licensed between April 1 and June 30 and

pays the fee required under clause (

b) is not required to pay a fee on July

1 of that year.

Section 4 is amended

(

a) in clauses (

a) and (

b) by striking out "$75" and substituting

"$60";

(

b) by repealing clause (i).

Section 5 is amended by striking out "$75" and substituting "$60".

Section 14 is repealed and the following is substituted:

14 The fee payable by a transportation company, travel agency or

automobile dealer for a restricted certificate under

section 509 of the Act

is as follows and is based on the number of employees soliciting insurance

on behalf of the company, agency or dealer

(a) 1 - 4 employees $100

(b) 5 - 10 employees $175

(c) 11 - 15 employees $325

(d) 16 - 20 employees $450

(e) 21 - 99 employees $600

(f) 100 - 249 employees $1000

(g) 250 - 499 employees $2500

(h) 500 - or more $5000.

Section 17.1 is amended by repealing subsections (3) and (4).

7(1) This Regulation except for

section 5 comes into force on April 1,

(2) Section 5 comes into force on the coming into force of

section 1(89)

of the Financial Institutions Statutes Amendment Act, 1996.

Alberta Regulation 60/97

Public Sector Pension Plans Act

PUBLIC SERVICE PENSION PLAN AMENDMENT REGULATION

Filed: March 18, 1997

Made by the Lieutenant Governor in Council (O.C. 126/97) pursuant to

Schedule 2,

section 4 of the Public Sector Pension Plans Act.

1 The Public Service Pension Plan (AR 368/93) is amended by this

Regulation.

Section 2(1)(

p) is amended by striking out "to whom the Management

Employees Pension Plan applied by virtue of

section 118 of that Plan and

who ceased to be a participant of the Management Employees Pension Plan at

the end of 1996 on the expiry of that provision" and substituting

"described in

section 3(5.3)".

3 The following is added after

section 3(5.1):

(5.2) In subsection (5.3),

(a) "ASC" means the Alberta Securities Commission;

(b) "ASC management position" means a position with ASC

such that, if ASC were a full participating employer for all purposes under

MEPP, occupation of that position would render the person a participant of

and within the meaning of MEPP;

(c) "MEPP" means the Management Employees Pension Plan

or the Management Employees Pension Plan, as the case may be.

(5.3) The following persons engaged to work for ASC are not

employees:

(

a) a person to whom MEPP applied by virtue of

section

118 of MEPP and who ceased to be a participant of MEPP at the end of 1996

on the expiry of that provision;

(

b) a person appointed after the end of March 1996 to

an ASC management position;

(

c) a person who, if ASC were a full MEPP participating

employer, as referred to in subsection (5.2)(b), would not be an employee

under and within the meaning of MEPP or in an ASC management position

because only of his being excluded from the established policy for pension

coverage referred to in

section 2(1)(p)(ii) of MEPP.

Provincial Offences Procedure Act

PROCEDURES AMENDMENT REGULATION

Filed: March 18, 1997

Made by the Lieutenant Governor in Council (O.C. 128/97) pursuant to

section 41 of the Provincial Offences Procedure Act.

1 The Procedures Regulation (AR 233/89) is amended by this Regulation.

Schedule 2,

Part 6, is amended by adding the following after

section 1:

1.1 Notwithstanding item 64 in

section 2, with respect to the

failure to keep and maintain a school bus and all equipment of the school

bus in a condition of conformity with the standards and specifications

prescribed in

Schedule 4 of the Bus Safety Regulation, the specified

penalty payable for a contravention of

section 55(1) is $300.

Highway Traffic Act

BUS SAFETY AMENDMENT REGULATION

Filed: March 18, 1997

Made by the Lieutenant Governor in Council (O.C. 129/97) pursuant to

sections 7, 8 and 12 of the Highway Traffic Act.

1 The Bus Safety Regulation (AR 235/82) is amended by this Regulation.

2 The heading to

Part 3 is repealed and the following is substituted:

PART 3

COMPLIANCE WITH SAFETY STANDARDS

3 The following is added immediately before

section 13:

12.1(1) In this section,

(a) "bus" means a bus other than a bus used exclusively

for personal transportation;

(b) "equipment" means the equipment referred to in

Schedule 4.

(2) The owner of a bus shall keep and maintain the bus and all its

equipment in a condition of conformity with the standards and

specifications prescribed in

Schedule 4.

4 The

Schedule to this Regulation entitled

Schedule 4 is added after

Schedule 3:

SCHEDULE 4

1 A bus as defined in

section 12.1 of this Regulation must meet the

following standards and specifications:

(

a) the main and emergency exits must operate easily and must close

securely;

(

b) the emergency door must be unobstructed, and must be easily

opened from inside and outside the vehicle;

(

c) in the case of a friction brake,

(

i) the bonded lining must not be thinner than 2

millimetres when measured at the thinnest point;

(ii) a riveted lining surface must not be closer than 2

millimetres to any rivet head or bolt;

(iii) a disc pad must not be less than 2 millimetres in

thickness when measured at its thinnest point to a rivet head or to a

backing plate of a bonded lining and a wear indicator must not be in

contact with a disc;

(

d) in the case of an emergency brake or a parking brake,

(

i) the brake while set but not held by hand in the

fully applied position must hold the bus;

(ii) the brake drum disc or facing must not be broken

nor worn thinner than 2 millimetres in thickness when measured at its

thinnest point to the rivet head or shoe;

(

e) in the case of an air system, the low pressure warning light or

buzzer must operate;

(

f) in the case of a dual braking system, the brake failure warning

light must function in accordance with the manufacturer's specifications;

(

g) the steering column and steering box must be securely mounted

to the body and frame;

(

h) in the case of wheels,

(

i) a wheel must not be bent or cracked;

(ii) the bolts, lugs, spacers, lock rings and nuts must

not be defective or missing;

(iii) the rims must not be bent or cracked;

(

i) in the case of tires,

(

i) a tire must not be worn so that

(

A) the tread wear indicators contact the

road, or

(

B) less than 2 millimetres of the tread

remains on 2 adjacent treads;

(ii) on vehicles of 4500 kilograms gross vehicle weight

or more, the front tire tread depth must not be less than 2 millimetres;

(iii) a tire must not have exposed cord at worn spots;

(iv) a recap tire must not be used on front wheels;

(

j) in the case of first aid, fire and road side emergency

equipment, the bus must be equipped with the following:

(

i) a fire extinguisher that meets the requirements of

the CSA Std;

(ii) a first aid kit that meets the requirements of CSA

Std;

(iii) flares and flags that meet the requirements of CSA

Std;

(iv) triangles that meet the requirements of CSA Std.

Meat Inspection Act

MEAT INSPECTION AMENDMENT REGULATION

Filed: March 18, 1997

Made by the Lieutenant Governor in Council (O.C. 132/97) pursuant to

section 11 of the Meat Inspection Act.

1 The Meat Inspection Regulation (Alta. Reg. 51/73) is amended by this

Regulation.

Section 3 is amended by adding the following after subsection (1):

(1.1) Meat and meat products obtained from wild game donated to an

organization for distribution by that organization without charge is exempt

from the Act and this Regulation, if that organization has obtained a

waiver under the Waiver Regulation (Alta. Reg. 249/85) that waives the

application of

section 19(

e) of the Food Regulation (Alta. Reg. 240/85) to

that meat and those meat products.

section 6 of the Natural Gas Royalty Regulation, 1994 (Alta. Reg.

351/93).

1 The Prescribed Amounts (Natural Gas Royalty) Regulation (AR 36/95) is

amended by this Regulation.

Section 4 is amended by adding the following after subsection (25):

(26) The following prices are prescribed for the January, 1997

1 The Apprenticeship Training Regulation (AR 2/92) is amended by this

Regulation.

2 Sections 11 and 12 are repealed and the following is substituted:

Replacement of documents

11 On receipt of an application the Minister may replace any

document issued pursuant to the Act or the regulations if the Minister or

the Executive Director is satisfied that there is a valid reason to replace

the document.

3 The following is added after

section 14:

Fees

15 The Minister may charge fees for services provided under the Act

or the regulations.

Made by the Alberta Apprenticeship and Industry Training Board pursuant to

section 37(2) of the Apprenticeship and Industry Training Act.

1 The Warehousing Occupation Regulation (AR 127/96) is amended by this

Regulation.

Section 5 is amended

(

a) in subsection (2) by striking out "not later than August 1,

1997" and substituting "apply to the Minister to";

(

b) by adding the following after subsection (2):

(2.1) In order to be granted an occupational certificate pursuant to

an application made under subsection (2), the application must be made to

the Minister not later than December 31, 1998.
