On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Motor Vehicle Act Regulations, B.C. Reg. 26/58, are amended as set out in the attached Appendix.

Appendix

1 The Motor Vehicle Act Regulations, B.C. Reg. 26/58, are amended by adding the following section:

Prescribed provisions

1.02 For the purpose of paragraph (

f) of the definition of “ motor vehicle related Criminal Code offence ” in

section 1 of the Act,

section 253 (3) (a), (

b) and (

c) of the Criminal Code is prescribed.

2 Table 3 of the

Schedule to Division 28 is amended by adding the following headings and item as indicated:

Section 253 (3) (

b) Operation of motor vehicle with blood drug concentration in prescribed range

3 Table 4 of the

Schedule to Division 28 is amended under the heading “ Criminal Code ”

(

a) by repealing items 14 and 15 and substituting the following as indicated:

Section 253 (1) (

a) Operation of motor vehicle while ability impaired by alcohol or drugs

Section 253 (1) (

b) Operation of motor vehicle with more than 80 milligrams of alcohol in blood

, and

(

b) by adding the following items as indicated:

a) Operation of motor vehicle with blood drug concentration equal to or exceeding prescribed value

section 46.04 is amended

a) by adding the following items as indicated:

b) of the Criminal Code in respect of a motor vehicle [operates a motor vehicle with a blood drug concentration in a prescribed range]

9.3

Person has been convicted of an offence under

section 253 (3) (

c) of the Criminal Code in respect of a motor vehicle [operates a motor vehicle with a blood alcohol concentration and blood drug concentration equal to or exceeding prescribed values]

(

b) in column 3 of item 11 by striking out “ 0 ” and substituting “ 6 ”, and

(

c) in column 3 of item 14 by striking out “ 0 ” and substituting “ 6 ”.
