EXPLANATORY NOTE NOTE EXPLICATIVE This Bill amends The Freedom of Information and Protection of Privacy Act . The following are the key changes. Le présent projet de loi modifie la

Voici les principales modifications apportées à la Loi : Information and Privacy Adjudicator h An Information and Privacy Adjudicator is to be appointed as an officer of the Legislative Assembly. The adjudicator has the power, at the request of the Ombudsman, to issue an order against a public body that has not acted on the Ombudsman's recommendations.

For example, an order could require a public body to release information that has been withheld from an applicant, or require a public body to change the way it collects, uses or discloses personal information. Access to information h The closure period for Cabinet records is reduced from 30 years to 20 years.

A similar reduction is made for confidential records of local public bodies. h Clarification is added to ensure that opinion polls paid for by public bodies cannot be withheld from a person applying for access because of the exception in the Act for "advice to a public body". h Information that public bodies receive from First Nations' authorities is given the same protection from release as information received from other governments. h Public bodies are given discretion to disregard access requests that are incomprehensible, frivolous or vexatious or that, because of their repetitious or systematic nature, would interfere unreasonably with the public body's operations. h The government is obliged to release a

summary of each Minister's yearly expenses. h The requirement in the current Act that public bodies prepare directories of records is removed. Accès à l'information h La période de protection des documents du Cabinet passe de 30 ans à 20 ans.

Protection of privacy h Public bodies are permitted to use and disclose personal information for the purpose of delivering integrated services. h Public bodies are permitted to use and disclose personal information in order to evaluate their programs. h Universities and colleges are permitted to disclose contact information about alumni for fundraising purposes, subject to specified conditions.

a) processes, stores or destroys personal information for a public body, or 2(1)

7 16(6) Subsection 44(1) is amended by striking out " or " at the end of clause (bb), adding " or " at the end of clause (cc) and adding the following after clause (cc): (dd) if the public body is an educational institution and the disclosure is for the purpose of fundraising activities of the educational institution, but only if (

b) allow individuals, on request, a right of access to personal information that is disclosed about them under clause (1)(dd); and (

c) require that the person to whom the information is disclosed cease to use the personal information of any individual who so requests. Removal or suspension 58.2(1) The Lieutenant Governor in Council may suspend or remove the adjudicator from office on a resolution of the Assembly carried by a vote of 2/3 of the members voting. section 66.3, the adjudicator must dispose of the i ssues by making an order under this section. b) confirm the decision of the head or require the head to reconsider it, if the adjudicator determine s that the head is authorized to refuse access; (

c) confirm the decision of the head or require the head to refuse access to all or part of the record, if the adjudicator determines that the head is require d to refuse access. c) confirm or reduce a fee, or order a refund of a fee, in the appropriate circumstances; (

d) confirm a decision not to correct personal information, or specify how personal information is to be corrected; (

e) require a public body to cease or modify a specified practice of collecting, using or disclosing personal information in contravention of

Part 3; (

17 Limit 66.8(4) If the adjudicator determines that the head is authorized or required to refuse access to a rec ord or part of a record, the adjudicator must not order the head to disclose the record or part of it. 18 Judicial review 66.10(1) An application for judicial review of an adjudicator's order must be made within 25 days aft er the person making the application is given a copy of the order, unless the court extends the period. section 46 before the coming int o force of this section, disclosed names, addresses a nd drivers' licence numbers to the War Amputations of Canada, the public body may continue to disclose th at information despite subsection 44(1) (restrictions on disclosure), if War Amputations of Canada uses the information only in accordance with the terms of th e agreement.
