On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the attached Land Act Shellfish Aquaculture Fees Regulation is made. — S. LAND ACT SHELLFISH AQUACULTURE

FEE REGULATION

Definitions

1 In this regulation:

"expansion of shellfish aquaculture disposition" means an addition of new land to the land which is the subject of a shellfish aquaculture disposition;

"extension of shellfish aquaculture disposition" means a shellfish aquaculture disposition which extends an existing shellfish aquaculture disposition for a term of not more than ten years if:

(

a) an applicant holds the existing shellfish aquaculture disposition on the date this regulation is made;

(

b) the existing shellfish aquaculture disposition expired in good standing not more than 30 days before an application is made for its extension;

"replacement shellfish aquaculture disposition" means a shellfish aquaculture disposition which replaces an existing shellfish aquaculture disposition or a shellfish aquaculture disposition, held by an applicant, which expired in good standing not more than 30 days before an application is made for its replacement;

"shellfish aquaculture" means the growing and cultivation of aquatic plants, shellfish, or other aquatic invertebrates for commercial purposes, in any water environment or in human made containers of water, in or under the foreshore or in water;

"shellfish aquaculture disposition" means a lease, licence of occupation or permit issued under the Land Act for the purpose of shellfish aquaculture.

Shellfish aquaculture fees

2 A person applying under the Land Act for a matter itemized in Column 1 of the

Schedule must pay the fee set out opposite that item in Column 2 of the Schedule.

Exceptions to application of Land Act Fees Regulation

3 The fees set out in items 1, 4, 5, 6, 10 and 13 of the Land Act Fees Regulation do not apply to shellfish aquaculture dispositions, replacement shellfish aquaculture dispositions or expansions of shellfish aquaculture dispositions.
