Health insurance Premiums Act

HEALTH INSURANCE PREMIUMS AMENDMENT REGULATION

on February 3, 2011 pursuant to sections 2 and 21 of the Health Insurance Premiums

Act.

1 The Health Insurance Premiums Regulation (AR 217/81)

is amended by this Regulation.

2 The following provisions are amended by striking out

"his" and substituting "his or her":

section 1(2)(f);

section 3(1).

Section 7 is amended

(

a) in subsection (2)

(

i) by striking out "he" wherever it occurs and

substituting "the registrant";

(ii) in clause (

b) by striking out "him" and

substituting "the registrant";

(

b) by repealing subsection (4).

Section 8 is amended

(

a) in subsection (3) by striking out "he" and

substituting "he or she";

(

b) in subsection (4)

(

i) by striking out "his application" and substituting

"his or her application";

(ii) by striking out "he may" and substituting "he or

she may";

(iii) by striking out "his premium" and substituting

"the registrant's premium".

Section 9 is amended

(

a) in subsection (1) by striking out "he is unable to pay his

premiums" and substituting "the registrant is unable to

pay his or her premiums";

(

b) in subsection (1.1) by striking out ", or" at the end of

clause (

a) and repealing clause (b);

(

c) by repealing subsection (3.1) and substituting the

following:

(3.1) In making an application for waiver of premiums,

(

a) an applicant shall disclose in the application the

applicant's gross income received from all sources

during the 3 calendar months immediately preceding the

date of the application,

(

b) an applicant with dependants shall include in the

application the gross income received from all sources

by the applicant's dependants during the 3 calendar

months immediately preceding the date of the

application, and

(

c) an applicant who has rental income or income from

self-employment, investment or a business, including a

farming operation, shall disclose in the application the

applicant's expenses in respect of the self-employment,

investment, rental operation or business and the

expenses shall be deducted from the applicant's gross

income for the purposes of this section.

(

d) in subsection (3.3) by striking out "his" and

substituting "his or her";

(

e) in subsection (3.5) by striking out "the Department of

Family and Social Services" and substituting "the

Department of Children and Youth Services, the Department

of Employment and Immigration or the Department of

Seniors and Community Supports";

(

f) in subsection (3.6) by striking out "his" and

substituting "his or her";

(

g) in subsection (3.7)

(

i) by striking out "he" and substituting "the

applicant";

(ii) by striking out "his" and substituting "the

applicant's".

Section 10 is amended

(

Section 11(4) is amended

(

(

Section 12 is amended

substituting "section 8 of the Alberta Health Care Insurance

Regulation (AR 76/2006)".

Section 33 is amended

(

a) in subsection (1) by striking out "him have been made,

then he shall be assumed no longer a resident of Alberta and

his" and substituting "the registrant have been made, then

the registrant shall be assumed to no longer be a resident of

Alberta and his or her";

(

b) in subsection (2)

(

i) by striking out "he" wherever it occurs and

substituting "the registrant";

(ii) by striking out "his" and substituting "the

registrant's";

(

located for any periods during which the registrant" and
