On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that

(

a) the Provider Regulation, B.C. Reg. 222/2014, is amended as set out in the attached Schedule, and

(

b) effective April 1, 2021,

section 22 (2) (

c) of the Provider Regulation is amended by striking out "or 3.1 (2) or (3) [transition – opioid agonist treatment provider sub-class] ".

Schedule

Section 1 of the Provider Regulation, B.C. Reg. 222/2014, is amended

(

a) in paragraph (

a) of the definition of "class" by striking out " methadone maintenance provider " and substituting " opioid agonist treatment provider ", and

(

b) by repealing the definition of "methadone maintenance services" and substituting the following:

"opioid agonist treatment services" means services provided by a pharmacist described in

section 3 (4) [enrollment of pharmacy providers] in relation to the dispensing of a drug for opioid agonist treatment; .

2 Sections 3 (4), 7 (1) (f), 9 (2), 13 (2), 19 and 22 (2) (

c) are amended by striking out " methadone maintenance provider " and substituting " opioid agonist treatment provider ".

3 Sections 3 (4), 9 (2), 13 (2) and 22 (3) (

a) are amended by striking out " methadone maintenance services " and substituting " opioid agonist treatment services ".

Section 3 is amended by adding the following subsection:

(5) A provider who was enrolled in the methadone maintenance provider sub-class immediately before the date this

section comes into force is deemed to be enrolled in the opioid agonist treatment provider sub-class.

5 The following

section is added:

Transition – opioid agonist treatment provider sub-class

3.1

(1) In this section, "OAT training program" means the training program entitled "BCPhA Opioid Agonist Treatment Compliance and Management Program for Pharmacy", provided by the British Columbia Pharmacy Association.

(2) Despite

section 3 (4) and (5), a provider who is enrolled in the opioid agonist treatment provider sub-class must ensure that at least one pharmacist who provides drugs, devices, substances or related services through the provider's pharmacy completes the OAT training program within 6 months after the date this

section comes into force.

(3) Despite

section 3 (4), if a person applies, during the period that begins 6 months after the date this

section comes into force and ends March 31, 2021, to enrol in the opioid agonist treatment provider sub-class, the applicant is not eligible for enrolment unless at least one pharmacist who provides drugs, devices, substances or related services through the applicant's pharmacy has completed the OAT training program.

(4) This

section is repealed April 1, 2021.

Section 13 (2) (

a) is amended by striking out " and entitled "Methadone Maintenance Controlled Prescription" ".

Section 19 is amended by striking out " methadone " and substituting " a drug for opioid agonist treatment ".

Section 22 (2) (

c) is amended by adding " or 3.1 (2) or (3) [transition – opioid agonist treatment provider sub-class] " after "

section 3 (4) [enrollment of pharmacy providers] ".
