MOTION MOTION In Committee Étude en comité AMENDMENT TO BILL AMENDEMENT AU PROJET DE LOI THE PUBLIC SERVICE ACT

LOI SUR LA FONCTION PUBLIQUE Moved by the Honourable Mr. Eichler Motion de M. le ministre Eichler THAT the following be added after Clause 64(6) of the Bill: Il est proposé d'ajouter, après le paragraphe 64(6) du projet de loi, ce qui suit : Exception — appeal to commission 64(6.1) Subsection (6) does not apply to a reference to the former Act or a specific provision of it in relation to an appeal that is commenced after the coming into force of this

section under a collective agreement described in that subsection. For greater certainty, a provision of the collective agreement that provides for an appeal to The Civil Service Commission is of no force and effect and The Labour Relations Act applies instead.

Reference to commission in collective agreement 64(6.2) Despite subsection (6) but subject to subsection (6.1), any reference to The Civil Service Commission in a collective agreement entered into before the coming into force of this

section is deemed to refer to the Public Service Commissioner appointed under subsection 26(1) of this Act.
