SCHOOL AMENDMENT ACT, 2017

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

This Bill amends the School Act to require a by-election to be held within one year of trustees being removed and an official trustee being appointed to a District Board of Education.

Section 172 of the School Act, R.S.B.C. 1996, c. 412, is amended

(

a) in subsection (3), by striking out " The Lieutenant Governor in Council " and substituting " Providing the next general local election is scheduled to be held within 12 months, the Lieutenant Governor in Council ", and

(

b) by adding the following subsection:

(4) If the next general local election is not already scheduled to be held in the 12 months that follow an official trustee's appointment, a District Board of Education by-election must be held within 12 months.

Explanatory Note

This Bill amends the School Act to require a by-election to be held within one year of trustees being removed and an official trustee being appointed to a District Board of Education.
