B.C. Reg. 145/2021 , deposited June 7, 2021, under the MOTOR VEHICLE AMENDMENT ACT, 2020 [section 32] and the MOTOR VEHICLE ACT [sections 210 (2), 214.5 and 214.6]. Order in Council 331/2021, approved and ordered

June 7, 2021.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that

(

a) section 1 of the Motor Vehicle Amendment Act, 2020 , S.B.C. 2020, c. 9, is brought into force,

(

b) the Motor Vehicle Act Regulations, B.C. Reg. 26/58, are amended as set out

in the attached

Schedule 1, and

(

c) the Use of Electronic Devices While Driving Regulation, B.C. Reg. 308/2009,

is amended as set out in the attached

Schedule 2.

Schedule 1

Section 4.28 of the Motor Vehicle Act Regulations, B.C. Reg. 26/58, is amended

(

a) in subsection (2) by adding the following paragraphs:

(

e) an official vehicle driven by a fishery officer designated under

section 5 (1)

of the Fisheries Act (Canada) in the discharge of the officer's duties under that Act or the Coastal Fisheries Protection Act (Canada);

(

f) an official vehicle driven by a sheriff, in the discharge of the sheriff's

duties under the Sheriff Act , while transporting a person in the lawful custody of a sheriff. , and

(

b) in subsection (8) by repealing paragraph (

g) and adding the following:

(a.1) a designated constable of the Stl'atl'imx Tribal Police Service, appointed

under

section 4.1 (11) of the Police Act ;

(a.2) a designated constable of the South Coast British Columbia Transportation

Authority Police Service, appointed under

section 4.1 (11) of the Police Act ;

(a.3) a designated constable of the Organized Crime Agency of British Columbia,

appointed under

section 4.1 (11) of the Police Act ;

(a.4) a person appointed under

section 38.06 (2) of the Police Act to serve as an investigator with the Independent Investigations Office;

(g.1) a fishery officer designated under

section 5 (1) of the Fisheries Act (Canada); .

Schedule 2

Section 5 of the Use of Electronic Devices While Driving Regulation, B.C. Reg. 308/2009,

is amended by adding the following paragraph:

(

c) a sheriff, in the discharge of the sheriff's duties under the Sheriff Act , while transporting a person in the lawful custody of a sheriff.
