OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated December 7, 2004, pursuant to

Section 16 of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, is pleased to: (

a) approve the issuance of a lease by the Minister of Natural Resources of a parcel of Crown land containing approximately 1 hectare, situate at Cape Mabou Highlands, Inverness County, the exact location and total number of hectares to be determined upon survey, and shown outlined in red on the plan marked

Schedule "A" attached to and forming part of the Report and Recommendation, to Black River Hydro Limited, a body corporate with its registered office at Black River, Inverness County, for the purpose of wind energy generation, and for no other purpose, for a term of twenty (20) years at the annual rent of thirty-five hundred dollars ($3,500.00) per megawatt of capacity per tower for the first ten (10) years, with a minimum annual rent of fifteen hundred dollars ($1500.00) per tower, thereafter calculated at 2% of the gross revenue derived from the leased site or thirty-five hundred dollars ($3,500.00) per megawatt per tower per annum whichever is greater, with a minimum annual rent of fifteen hundred dollars ($1,500.00) per tower, with the right to renew the lease for a further twenty (20) year term at a rent to be fixed by the Lessor, provided that the Lessee has satisfactorily complied with terms and conditions of the lease; and (

b) authorize the Minister of Natural Resources to execute such documents as may be necessary to achieve the purposes of this Order.
