Order in Council 64/2023, approved and ordered February 10, 2023.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective February 10, 2023,

(

a) for the purposes of

section 89 (1) of the Professional Governance Act , the profession of architecture is designated,

(

b) the Professional Governance Act , S.B.C. 2018, c. 47, is amended as set out in the attached

Schedule A,

(

c) the regulations set out in the attached

Schedule B are amended as set out in that Schedule, and

(

d) the Architects Act , R.S.B.C. 1996, c. 17, is repealed.

Schedule A

Section 1 of

Schedule 1 of the Professional Governance Act, S.B.C. 2018, c. 47, is amended by adding the following paragraph:

(

f) the Architectural Institute of British Columbia .

Schedule 1 is amended by adding the following section:

Definitions in respect of the Architectural Institute of British Columbia

7 For the purposes of this Act and other enactments that refer to this Act, the following

definitions apply in respect of the Architectural Institute of British Columbia:

"architect" means an individual who is registered with the regulatory body as an architect under this Act;

"registrant" means, as applicable,

(

a) an architect,

(

b) a firm that is registered with the regulatory body under this Act, if firms may be registered in respect of the regulatory body, or

(

c) an individual or firm, as applicable, that is registered with the regulatory body as another category or subcategory of registrant in accordance with the bylaws of the regulatory body;

"regulated practice" means the prescribed scope of practice of architecture carried on by registrants;

"regulatory body" means the Architectural Institute of British Columbia.

Schedule 2 is amended by adding the following:

Architectural Institute of British Columbia .

Schedule 3 is amended by adding the following:

Schedule B

Bare Land Strata Regulations

Section 1 of the Bare Land Strata Regulations, B.C. Reg. 75/78, is amended in the definition of "professional engineer" by striking out " professional engineering licensee " and substituting " professional licensee engineering ".

Cremation, Interment and Funeral Services Regulation

Section 1 of the Cremation, Interment and Funeral Services Regulation, B.C. Reg. 298/2004, is amended

(

a) in the definition of "professional engineer" by striking out " professional engineering licensee " and substituting " professional licensee engineering ", and

(

b) in the definition of "professional geoscientist" by striking out " professional geoscience licensee " and substituting " professional licensee geoscience ".

Dam Safety Regulation

Section 1 of the Dam Safety Regulation, B.C. Reg. 40/2016, is amended in the definition of "engineering professional" by striking out " professional engineering licensee " and substituting " professional licensee engineering ".

Employment Standards Regulation

Section 31 of the Employment Standards Regulation, B.C. Reg. 396/95, is amended

(

a) by repealing paragraph (a),

(

b) in paragraph (

f) by striking out " professional engineering licensee " and substituting " professional licensee engineering ", and

(

c) by adding the following paragraph:

(f.1) an architect, architectural technologist or intern architect under the Professional Governance Act , .

Engineers and Geoscientists Regulation

5 The Engineers and Geoscientists Regulation, B.C. Reg. 14/2021, is amended

(

a) in

section 2 by repealing the definition of "professional engineering licensee" and adding the following definition:

"professional licensee engineering" means a registrant who is authorized by the regulatory body to use the title "professional licensee engineering". ,

(

b) in sections 4 (

b) and 5 (1) by striking out " professional engineering licensee " and substituting " professional licensee engineering ",

(

c) in

section 6 by repealing the definition of "professional geoscience licensee" and adding the following definition:

"professional licensee geoscience" means a registrant who is authorized by the regulatory body to use the title "professional licensee geoscience". , and

(

d) in sections 8 (

b) and 9 (1) by striking out " professional geoscience licensee " and substituting " professional licensee geoscience ".

Forest Planning and Practices Regulation

Section 22.1 (1) (

a) of the Forest Planning and Practices Regulation, B.C. Reg. 14/2004, is amended

(

a) in subparagraph (iii) by striking out " professional engineering licensee " and substituting " professional licensee engineering ", and

(

b) in subparagraph (iv) by striking out " professional geoscience licensee " and substituting " professional licensee geoscience ".

Greenhouse Gas Emission Reporting Regulation

Section 21 (1) of the Greenhouse Gas Emission Reporting Regulation, B.C. Reg. 249/2015, is amended

(

a) in the definition of "professional engineer" by striking out " professional engineering licensee " and substituting " professional licensee engineering ", and

(

b) in the definition of "professional geoscientist" by striking out " professional geoscience licensee " and substituting " professional licensee geoscience ".

Homeowner Protection Act Regulation

Section 4.05 (2) (

b) of the Homeowner Protection Act Regulation, B.C. Reg. 29/99, is amended

(

a) by repealing subparagraphs (

i) and (v), and

(

b) in subparagraph (v.1) by striking out " relates to professional engineering " and substituting " relates to architecture, professional engineering ".

Mining Rights Compensation Regulation

Section 4 (1) (

a) of the Mining Rights Compensation Regulation, B.C. Reg. 19/99, is amended

(

a) by striking out " professional engineering licensee ", and substituting " professional licensee engineering ", and

(

b) by striking out " professional geoscience licensee " and substituting " professional licensee geoscience ".

Pool Regulation

Section 4 of the Pool Regulation, B.C. Reg. 296/2010, is amended

(

a) in the definition of "architect" by striking out " Architects Act " and substituting " Professional Governance Act ", and

(

b) in the definition of "engineer" by striking out " professional engineering licensee " and substituting " professional licensee engineering ".

Professional Governance General Regulation

11 The Professional Governance General Regulation, B.C. Reg. 107/2019, is amended

(

a) in

section 1.1 by striking out " in

section 1 (1) of the Act, " and substituting " in

section 1 (1) of the Act, with respect to the Association of Professional Engineers and Geoscientists of the Province of British Columbia ",

(

b) by repealing

section 1.4 and substituting the following:

Definitions

1.4 In this Division:

"historical member" means, as applicable,

(

a) in relation to a regulatory body continued under Division 1 of

Part 7 of the Act, a person who, before February 5, 2021, ceased to be a registered member of the professional regulator continued as a regulatory body, or

(

b) in relation to a regulatory body established under Division 2 of

Part 7 of the Act, a person who, before the designation date of the profession of the person, ceased to be a registered member of the professional regulator established as a regulatory body;

"recent historical member" means, as applicable,

(

a) in relation to a regulatory body continued under Division 1 of

Part 7 of the Act, a person who, on or after February 5, 2014, ceased to be a registered member of the professional regulator continued as a regulatory body, or

(

b) in relation to a regulatory body established under Division 2 of

Part 7 of the Act, a person who, within 7 years before the designation date of the profession of the person, ceased to be a registered member of the professional regulator established as a regulatory body. ,

(

c) by repealing

section 1.6 (1),

(

d) in

section 1.6 (3) (

a) and (

b) and (5) by striking out " continued professional association " and substituting " professional regulator ", and

(

e) in

section 8 (1) (c) (

i) by striking out " professional association " and substituting " professional regulator ".

Reviewable Projects Regulation

12 Table 9 of the Reviewable Projects Regulation, B.C. Reg. 243/2019, is amended

(

a) in column 2 in criteria (2) (a) (ii) opposite category 4 in column 1 by striking out " person registered as a member " and substituting " registrant ", and

(

b) in column 3 in criteria (2) (a) (ii) opposite category 4 in column 1 by striking out " person registered as a member " and substituting " registrant ".

Riparian Areas Protection Regulation

Section 21 (2) (

a) of the Riparian Areas Protection Regulation, B.C. Reg. 178/2019, is amended

(

a) in subparagraph (iv) by striking out " professional engineering licensee " and substituting " professional licensee engineering ", and

(

b) in subparagraph (vi) by striking out " professional geoscience licensee " and substituting " professional licensee geoscience ".

School Tax Exemptions and Refunds (Approved and Eligible Hydroelectric Power Projects) Regulation

Section 1 of the School Tax Exemptions and Refunds (Approved and Eligible Hydroelectric Power Projects) Regulation, B.C. Reg. 144/2005, is amended in the definition of "professional engineer" by striking out " professional engineering licensee " and substituting " professional licensee engineering ".

Security Services Regulation

Section 2 (2) (

n) of the Security Services Regulation, B.C. Reg. 207/2008, is amended by striking out " professional engineering licensees " and substituting " professional licensees engineering ".

Water Sustainability Regulation

Section 36 (1) of the Water Sustainability Regulation, B.C. Reg. 36/2016, is amended in the definition of "engineering professional" by striking out " professional engineering licensee " and substituting " professional licensee engineering ".
