Bill 41 Government Bill Projet de loi 41 Projet de loi du gouve rnement 2nd Session, 40 th Legislature, Manitoba, 62 Elizabeth II, 2013 2e session, 40 e législature, Manitoba, 62 Elizabeth II, 2013 BILL 41 PROJET DE LOI 41 THE HIGHWAY TRAFFIC AMENDMENT ACT (ENHANCED SAFETY REGULATION OF HEAVY MOTOR VEHICLES) LOI MODIFIANT LE CODE DE LA ROUTE (SÉCURITÉ ACCRUE LIÉE AUX VÉHICULES AUTOMOBILES LOURDS) Honourable Mr. Ashton M. le ministre Ashton First Reading / Première lecture : Second Reading / Deuxième lecture : Committee / Comité : Concurrence and Third Reading / Approbation et troisième le cture : Royal Assent / Date de sanction :

EXPLANATORY NOTE NOTE EXPLICATIVE Currently under The Highway Traffic Act , certain motor vehicles and trailers that carry passengers or carg o for compensation and certain other heavy trucks (having a registered weight of 4,500 kg or more) — known respectively as public service vehicles and commerc ial trucks — are regulated to encourage operational and mechanical safety.

This Bill amends the Act so that substantially all motor vehicles having seating for 10 or more passengers o r a registered weight of 4,500 kg are subject to the sa me rules about operational and mechanical safety.

The amendments establish a new category of heavy mo tor vehicles to be known as "regulated vehicles" and br ing a number of previously exempt trucks into the commerc ial truck category by repealing the exemptions. That re peal will require those trucks to be registered as comme rcial trucks. Regulations may be made to exempt motor vehicles from the

definitions "commercial truck" and "regula ted vehicle".

The Bill makes minor amendments to the heavy vehicl e safety framework intended to ensure its effectivene ss and corrects two cross-references in unrelated provisio ns.
