An Act to Amend the Highway Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section of the Highway Act,

chapter H-5 of the Revised Statutes, 1973, is amended (

a) by repealing subsection (7) and substitut- ing the following: 37(7) The Minister may in writing designate a person as being qualified (

a) to operate an approved weighing device, or (

b) to test, determine and certify the accuracy of any approved weighing device. (

b) by repealing subsection (8); (

c) by repealing subsection (9) and substitut- ing the following: 37(9) A person who has been designated under paragraph (7)(

a) shall be deemed to be a qualified technician and a person designated under paragraph (7)(

b) shall be deemed to be a person qualified to PROJET DE LOI Loi modifiant la

An Act to Amend the Highway Act Bill EXPLANATORY NOTES

Section 1 (

a) The existing provision is as follows: 37(7) The Lieutenant-Governor in Council may designate a person as being qualified (

a) to operate an approved weighing device, or (

b) to test, determine and certify the accuracy of any ap- proved weighing device, (

b) The existing provision is as follows: 37(8) The Lieutenant-Governor in Council shall publish a no- tice of a designation under subsection (7) in The Royal Gazette. (

c) The existing provision is as follows: 37(9) Upon the publication of a notice of a designation in ac- cordance with subsection (8), a person designated under para- graph (7)(

a) shall be deemed to be a qualified technician and a person designated under paragraph (7)(

b) shall be deemed to be a person qualified to test, determine and certify the accuracy of any approved weighing device.

Article

a) La disposition actuelle se lit comme suit : 37(7) Le lieutenant-gouverneur en conseil peut désigner une personne comme étant une personne qualifiée

a) pour manoeuvrer un dispositif de mesure de poids ap- prouvé, ou

b) pour vérifier, déterminer et attester l'exactitude de tout dispositif de mesure de poids approuvé.

b) La disposition actuelle se lit comme suit : 37(8) Le lieutenant-gouverneur en conseil doit publier un avis d'une désignation prévue au paragraphe (7) dans la Gazette royale.
